RESOLU~ON NO.: 7656-02 BY: Corrigan, Dunn, George, l~oth, <br /> Seelie, Skindell. <br /> <br /> AN EMERGENCY RESOLUTION authorizing the Planning Commission an extension of time, until <br />June 17, 2002, for action on a referral from Council regarding the Ioca§on for an off-leash dog park in the <br />City of Lakewood pursuant to ARTICLE XII, SECTION 4 of the SECOND AMENDED CHARTER OF THE Cl-FY <br />OF LAKEWOOD regarding Handatory Referrals. <br /> <br /> WHEREAS, at the March ~1, 2002, City Coundl Meeting a referral regarding the issue of the location <br />of an off-leash dog park was made to the Planning Commission; and <br /> <br /> WHEREAS, the Charter requires such mandatory referrals to be acted upon with sixty (60) days from <br />the date of referral; and <br /> <br /> WHEREAS, at the April 2, 2002, Planning Commission Meeting, the Planning Commission accepted <br />fl~e referral from City Coundl; and <br /> <br /> WHEREAS, at the April 2, 2002, Planning Commission Meeting, the Planning Commission had a <br />presentation from the Friends of the Ideal Dog Park Off-leash (F.LD.O.); and <br /> <br /> WHEREAS, the Planning Commission held a community meeting on April 29, 2002, which was <br />attended by over two hundred people to hear the preliminary recommendations of the Planning <br />Commission regarding the location of an off-leash dog park; and <br /> <br /> WHEREAS, additional time will be needed to consider the extensive community input received at the <br />April 29, 2002 community meeting and through written correspondence; and <br /> <br /> WHEREAS, the Charter provides for an extension to the sixty C60) day time period if allowed by <br />Coundl; and <br /> <br /> WHEREAS, this Coundl by a vote of at least five (5) members elected thereto determines that this <br /> Resolution is an emergency measure, and that this Resolution shall take effect at the earliest date possible <br /> as set for~ in ARTICLE III, SECTIONS 10 and 13 of the SECOND AMENDED CHARTER OF THE ClTY OF <br /> LAKEWOOD, and that immediate action is necessary to provide for the preservation of the public health, <br /> safety and welfare and to provide for the immediate continuation of the review process by the Planning <br /> Commission regarding the location of an off-leash dog park in the City of Lakewood. NOW, THEREFORE, <br /> <br /> BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OH[O: <br /> <br />Section 1. That City Coundl authorizes the Planning Commission an extension of /dme, until <br />June 17, 2002, for action on. the referral from Coundl regarding the location for an off-leash dog park in the <br />City of Lakewood pursuant to ARTICLE XII, SECTION 4 of the SECOND AMENDED CHARTER OF THE CITY <br />OF LAKEWOOD regarding Mandatory Referrals. <br /> <br />Section 2. It is found and determined that all formal actions of this Coundl concerning and relating to <br />the passage of this Resolution were adopted in an open meeting of this Coundl, and that all such <br />deliberations of this coundl and any of its committees that resulted in such formal ac'dons, were in <br />meetings open to the public in compliance with all legal requirements. <br /> <br />Section 3. This Resolution is hereby declared to be an emergency measure for the reasons set forth <br />and defined in the Preamble of this Resolution, and provided it receives the affirmative vote of at least five <br />(5) of its members elected to Coundl, this Resolution shall take effect and be in force immediately upon its <br />adoption by the Council and approval by the Mayor; otherwise it shall, take effect and be in force after the <br />earliest period allowed by law. <br /> <br />Appmved: <br /> <br />President <br /> <br /> <br />
