REFERRED TO PUBLIC WORKS COMMITTEE 6/3/02. RESOLU1/ON NO. 7671~02 BY: Corrigan, Dunn, FitzGerald, George. Roth, Seelie, Skindell. A RESOLUTION committing the City of Lakewood to partidpate in a street resurfadng program for the resurfacing of West Clifton Boulevard in the C~y of Lakewood with the Ohio Department of Transportation. WHEREAS, the City of Lakewood and State of Ohio have identified the need for and proposed the improvement of the public highway which is described as follows: Apply a face-to-face of curb surface treatment of West Clifton Boulevard (SR-237/US-20) from approximately Riverside Dr'Ne to Clifton Boulevard (US-6) in the City of Lakewood, a total distance of 0.74 miles more or less; and WHEREAS, said portion of highway is within the munidpal corporation limits. Now therefore, BE TT RESOLVED BY THE C~TY OF LAKEWOOD, STATE OF OHIO Section 1. That it is declared to be in the public interest that the consent of said City be and such consent is hereby given to the Director of Transportation to construct the above described improvement, in accordance with plans, specifications and estimates as approved by the Director. Section 2. That the City hereby requests the cooperation of the Director of Transportation n in the cost of the above described improvement as follows: The City agrees to assume and contribute twenty percent (20%) of the cost and expense of the construction phase of this improvement determined to be eligible for State Highway Funds. In addition, the City shall install and/or repair all curb ramps which are necessary to ensure compliance with the Americans with Disabilities Act and the I_PA agrees to assume and bear one hundred percent (100%) of the cost of such installation and/or repair of curb ramps. And further, the City agrees to assume and contribute one hundred percent (100%) of the cost of any work included in the construction contract, at the request of the City, which is determined by the Director not to be part of or made necessary by the improvement. Section 3. The City agrees that all right-of-way required for the described project will be acquired and/or made available in accordance with current State and Federal regulations. The City also understands that right-of-way costs indude eligible utility costs. The City agrees that all utility accommodation, relocation and reimbursement will comply with the current provisions of 23 CFR 645 and the ODOT Utilities Manual. Section 4. The City shall maintain the right-of-way and keep it free of obstructions, and hold said right-of-way inviolate for public highway purposes. Section 5.
