RESOLUTZON NO. 7673-02 <br /> <br />BY: Corrigan, Dunn, FitzGerald, George, <br /> Roth, Seelie, Skindell. <br /> <br /> AN EMERGENCY RESOLUTION objecting to the transfer of ownership of a D5 <br />liqUor permit from Emprise Inc. to Moon Pie Inc. dba Hi-Fi Club and Grill for an <br />establishment located at 11729 Detroit Avenue, City of Lakewood, Ohio 44107. <br /> <br /> WHEREAS, the City has been advised that an application has been filed with the <br />Ohio Department of Uq uor Control to transfer the ownership of a D5 liquor permit from <br />Emprise Inc. to Moon Pie Inc. dba Hi-R Club & Grill for an establishment located at <br />11729 Detroit Avenue, Lakewood, Ohio; and <br /> <br /> WHEREAS, this matter has been referred to the Division of Police for a full <br />investigation and recommendation; and <br /> <br />WHEREAS, this Council has received and reviewed said recommendation; and <br /> <br /> WHEREAS, this Council by a vote of at least five (5) members elected thereto <br />determines that this resolution is an emergency measure, and that this resolution shall <br />take efl~ at the earliest date possible as set forth in ARTICLE III, SECTONS 10 and <br />13 of the SECOND AMENDED CHARTER OF THE Cl-rY OF LAKEWOOD, and that it is <br />necessary for the immediate preservation of the public property, health and safety, and <br />to provide for the usual daily operation of municipal departments in that the City of <br />Lakewood must either object to the transfer of these permits or forever waive an <br />objection on or before .lune 24, 2002. Now, therefore, <br /> <br /> BE 1-r RESOLVED BY THE COUNCIL OF THE CITY OF LAKEW~D, STATE OF <br />OHIO: <br /> <br /> Section 1. That the Coundl hereby objects to the transfer of ownership by the <br />Department of Liquor Control of the State of Ohio of a D5 liquor permit from the <br />premises known as Emprise Inc. to Moon Pie Inc. Inc; dba Hi-R Club & Grill for an <br />establishment located at 11729 Detroit Avenue, Lakewood, Ohio for reasons in <br />accordance with the provisions Ohio Revised Code §4303.292. <br /> <br /> Section 2. That the Clerk of Council is hereby authorized and directed to <br />forward a certified copy of this Resolution together with a letter requesting that the <br />headng be held in Cleveland, Cuyahoga County, Ohio, to the Department of Uquor <br />Control, State of Ohio, Permit Division, forthwith. <br /> <br /> Section 3. It is found and determined that all formal actions of this Council <br />concerning and relating to the passage of this resolution were adopted in an open <br />meeting of this Council, and that all such deliberations of this Council and of any of its <br />committees that resulted in such formal action were in meetings open to the public in <br />compliance with all legal requirements. <br /> <br /> Section 4. That this resolution is hereby declared to be an emergency <br />measure necessary for the immediate preservation of the public peace, property, <br />health, safety and welfare in the City and for the usual daily operation of the City for <br />the reasons set forth and defined in the preamble to this resolution, .and provided it <br />receives the affirmative vote of at least five (5) of its members elected to ~Council, this <br />resolution shall take effect and be in force immediately upon its adoption by the Council <br /> <br /> <br />
