RESOLUTION NO. 7679-02 <br /> <br />BY: Corrigan, Dunn, FitzGerald, <br />George, Roth, Seetie, Skindell. <br /> <br /> A RESOLUTION committing the City of Lakewood to participate in a retaining wall <br />project for the construction of a retaining wall on PJverside Drive in the City of <br />Lakewood with the Ohio Department of Transportation, <br /> <br /> WHEREAS, the City of Lakewood and State of Ohio have identified the need for <br />and proposed the improvement of the public highway and abutting retaining wall which <br />is described as follows: <br /> <br /> Abutting the south side of Riverside Drive (State Route 237) between <br />Niagra Drive and Hogsback Drive for a total length of approximately 300 feet; <br />and <br /> <br /> WHEREAS, said portion of highway and abutting retaining wall is within the <br />municipal corporation limits. Now therefore, <br /> <br />BE 1T RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO <br /> <br /> Section 1. That it is declared to be in the public interest that the consent of <br />said City beand such consent is hereby given to the Director of Transportation to <br />construct the above described improvement, in accordance with plans, specifications <br />and estimates as approved by the Director. <br /> <br /> Section 2. That the City hereby requests the cooperation of the Director of <br />Transportation n in the cost of the above described Improvement not to exceed forty- <br />five thousand dollars ($45,000). <br /> <br /> Section 3. The City agrees that all right-of-way required for the described <br />project will be acquired and/or made available in accordance with current State and <br />Federal regulaUons. The City alSO understands that right-of-way costs include eligible <br />uUlity costs. The City agrees that all utility accommodation, relocation and <br />reimbursement will comply with the current provisions of 23 CFR 645 and the ODOT <br />UUlities Manual. <br /> <br /> Section 4. The City shall maintain the right-of-way and keep it free of <br />obstructions, and hold said right-of-way inviolate for public highway purposes. <br /> <br /> Section 5. That the Mayor of the City of Lakewood is hereby empowered and <br />directed on behalf of the City to enter into agreements with the Director of <br />Transportation necessary to complete the planning and construction of this <br />improvement. <br /> <br /> Section 6. It is found and determined that all formal actions of this Coundl <br />concerning and relating to the passage of this ordinance were adopted in an open <br />meeting of this Council, and that all such deliberation of the Council and of any of its <br /> <br /> <br />
