RESOLUTION NO. 7679-02 BY: Corrigan, Dunn, FitzGerald, George, Roth, Seetie, Skindell. A RESOLUTION committing the City of Lakewood to participate in a retaining wall project for the construction of a retaining wall on PJverside Drive in the City of Lakewood with the Ohio Department of Transportation, WHEREAS, the City of Lakewood and State of Ohio have identified the need for and proposed the improvement of the public highway and abutting retaining wall which is described as follows: Abutting the south side of Riverside Drive (State Route 237) between Niagra Drive and Hogsback Drive for a total length of approximately 300 feet; and WHEREAS, said portion of highway and abutting retaining wall is within the municipal corporation limits. Now therefore, BE 1T RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO Section 1. That it is declared to be in the public interest that the consent of said City beand such consent is hereby given to the Director of Transportation to construct the above described improvement, in accordance with plans, specifications and estimates as approved by the Director. Section 2. That the City hereby requests the cooperation of the Director of Transportation n in the cost of the above described Improvement not to exceed forty- five thousand dollars ($45,000). Section 3. The City agrees that all right-of-way required for the described project will be acquired and/or made available in accordance with current State and Federal regulaUons. The City alSO understands that right-of-way costs include eligible uUlity costs. The City agrees that all utility accommodation, relocation and reimbursement will comply with the current provisions of 23 CFR 645 and the ODOT UUlities Manual. Section 4. The City shall maintain the right-of-way and keep it free of obstructions, and hold said right-of-way inviolate for public highway purposes. Section 5. That the Mayor of the City of Lakewood is hereby empowered and directed on behalf of the City to enter into agreements with the Director of Transportation necessary to complete the planning and construction of this improvement. Section 6. It is found and determined that all formal actions of this Coundl concerning and relating to the passage of this ordinance were adopted in an open meeting of this Council, and that all such deliberation of the Council and of any of its
