RESOLUTION 7738-03 BY: Corrigan, Dever, Dunn, <br /> George, Roth, Seelte. <br /> <br />AN EMERGENCY RESOLUTION authorizing and directing the Mayor, on behalf of the <br />City, to apply for financial assistance under the Clean Ohio Conservation Fund Program in <br />support of the expansion, resto, ration and revitalization of the iakefront at Lakewood Park. <br /> <br />Whereas, the State of Ohio, through the Ohio Public Works Commission, administers financial <br />assistance, and; <br /> <br />Whereas, the city of Lakewood would benefit from seeking 'outside sources to fund proposed <br />Lakewood Park waterfront improvements and expansions as detailed in the the Parks Master Plan <br />and elsewhere, and; <br /> <br />Whereas, tiffs Council by a vote of at least five (5) members elected thereto determines that this <br />resolution is an emergency measure, and that this resolution shall take effect at the earliest date <br />possible as set forth in ARTICLE III, SECTION 10 and 13 oftha SECOND AMENDED <br />CHARTER OF THE CITY OF LAKEWOOD, and that it is necessary for the immediate <br />preservation of the public property, health and safety, and to provide for the usual daily operation <br />of municipal departments applications for these funds must be postmarked no later than February <br />28, 2003. Now, therefore~ <br /> <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO <br /> <br />SECTION 1. That the Mayor, on behalf of the Ci~, be and is hereby authorized and directed to <br />execute and file and application for Clean Ohio Conservation Fund financial assistance with the <br />Ohio Public Works Commission and to provide all information and documentation required to <br />become eligible for possible funding assistance. <br /> <br />SECTION 2. That the City of Lakewood does agree to obligate the funds required to <br />satisfactorily complete the proposed project and become eligible for reimbursement under the <br />terms and conditions of the Clean Ohio Conservation Fund. <br /> <br />SECTION 3. It is found and determined that all formal actions of this Council concerning and <br />relating to the passage of this resolution were adopted in an open meeting of this Council, and <br />that all such deliberations of this Council and any of its committees that resulted in such formal <br />action, were in meetings open to the public, 'in compliance with all legal requirements. ' <br /> <br />SECTION 4. That this resolution is hereby deciared to be an emergency measure necessary for <br />the immediate preservation of the public peace, property, health, safety and welfare in the City <br />and for the usual daily operation of the City for the reasons set forth and defined in the preamble <br />to this resolution, and provided it receives the affn'mative vote of at least five ($) of its members <br />elected to Council, this resolution shall take effect and be in force immediately upon its adoption <br />by the Council and approval by the Mayor othe~vise, it shall be in force after the earliest period <br />allowed by law. ~. <br /> <br />FitzGerald, <br /> <br />President <br /> / <br /> <br /> <br />
