<br />RESOLUTION NO. 7921-04 <br /> <br />BY: Corrigan, Demro, Dever, Dunn. <br />FitzGerald, Madigan, Seelie. <br /> <br />AN EMERGENCY RESOLUTION authorizing the Mayor, for and on behaif of the <br />City, to seek financial assistance from the State Issue Two Infrastructure Bond Program <br />for funding of the 2005 Berea Road Improvement Project. <br /> <br />WHEREAS, pursuant to Article VIII of the Ohio Constitution, the State is <br />authorized to issue bonds and other obligations of the State of Ohio for the purpose of <br />financing public infrastructure capital improvements of political subdivisions as <br />designated by law; and <br /> <br />WHEREAS, pursuant to Section, 164.06 of the Ohio Revised Code, the District <br />One Publiç Works Integrating Committee is authorized to accept, evaluate and <br />recommend applications for state financing of capital infrastructure improvement <br />projects of political subdiviSions in Cuyahoga County; and <br /> <br />WHEREAS, pursuant to Section 164.05 of the Ohio Revised Code, the Director of <br />the Ohio Public Works Commission is authorized to accept and approve applications for <br />state finandng of capital infrastructure improvement project of political subdivisions in <br />Cuyahoga County; and <br /> <br />WHEREAS, the City of Lakewood has conducted a capital inventory and needs <br />assessment and has determined that it is necessary and desirable to apply for State <br />Issue Two Infrastructure Bond program funds for funding of the 2005 Berea Road <br />Improvement Project; and <br /> <br />WHEREAS, this Council by a vote of at least five (5) members elected thereto <br />determines that this resolution is an emergency measure, and that this resolution shall <br />take effect at the earliest date possible as set forth in ARTICLE III, SECTONS 10 and <br />13 of the SECOND AMENDED CHARTER OF THE cm OF LAKEWOOD, and that it is <br />necessary for the immediate preservation of the public property, health and safety, and <br />to provide for the usual daily operation of municipal departments in that if this <br />application is not made in a timely manner, the City will lose its opportunity to obtain <br />Issue Two Infrastructure Bond dollars. Now Therefore, <br /> <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO <br /> <br />Section 1. That the Mayor, for and on behalf of the City, is hereby authorized <br />to apply to the District One Public Works Integrating Committee and the Director of the <br />Ohio Public Works Commission for financial assistance for the following capital <br />improvement projects: <br /> <br />Berea Road Improvement Project <br /> <br />Section 2. The Mayor, for and on behalf of the City, is further authorized to <br />enter into any agreements as may be necessary and appropriate for obtaining such <br />
