<br />RESOLUTION NO: <br /> <br />7965-05 <br /> <br />BY- Corriga~, Demro, Dever, Dunn, <br />. FitzGerald,~Madlgan, Seelie. <br /> <br />AN EMERGENCY RESOLUTION withholding consent for the remission of <br />taxes, penalties and interest on an application for real property tax exemption <br />filed under section 3 of H.B. 362 of the 125th General Assembly. <br /> <br />WHEREAS, this Council by a vote of at least five (5) members elected <br />thereto determines that this resolution Is an emergency measure, and that this <br />resolution shall take effect at the earliest date possible as set forth in ARTICLE <br />III, SECTONS 10 and 13 of the SECOND AMENDED CHARTER OF THE CITY OF <br />LAKEWOOD, and that it is necessary for the Immediate preservation of the public <br />property, health and safety, and to provide for the usual dally operation of <br />municipal departments in that these agreements must be returned to the Ohio <br />Public Works Commission within 45 days of notice of award. Now Therefore, <br /> <br />BE IT RESOLVED, BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br />Section 1. This council objects to ¡J remission of taxes, penalties, and <br />interest for those tax years beyond the regular three-year remission period <br />contained In permanent law under Ohio Revised Code Section 5713.081(A). <br /> <br />Section 2. This council therefore withhoids its consent to any property <br />owner filing an exemption application with the tax commissioner under Section 3 <br />of Sub. H.B. No. 362 of the 125'h General Assembly seeking remission of taxes, <br />penalties and interest beyond the statutory period referred to in Section 1 of this <br />resolution. <br /> <br />Section 3. That the Clerk of Council is hereby directed to send certified <br />copies of this resolution to the Ohio Department of Taxation and to the <br />Cuyahoga County Auditor's Office. <br /> <br />Section 4. It Is found and determined that all formal actions of this Council <br />concerning and relating to the passage of this resoiution were adopted in an <br />open meeting of this Council, and that all such deliberations of this Council and <br />any of its committees that resulted in such formal action, were in meetings open <br />to the public, in compliance with all legal requirements. <br /> <br />Section 5.
