RESOLUTION NO. 8035-05 BY: Corrigan, Dernro, Dever, Dunn, FitzGerald, Madigan, Seelie. AN EMERGENCY RESOLUTION authorizing the Mayor, for and on behalf of the City, to seek financial assistance from the State Issue Two Infrastructure Bond Program for funding of the 2.006 Clifton Boulevard Improvement Project. WHEREAS, pursuant to Article VIII of the Ohio Constitution, the State is authorized to issue bonds and other obligations of the State of Ohio for the purpose of financing public infrastructure capital improvements of political subdivisions as designated by law; and WHEREAS, pursuant to Section 164.06 of the Ohio Révised Code, the District One Þublic Wor~ Integrating Committee is authorized to accept, evaluate and recommend applications for state financing of capitai infrastructure improvement projects of political subdivisions in Cuyahoga County; and WHEREAS, pursuant to Section 164.05 of the Ohio Revised Code, the Director of the Ohio Public Wor~ Commission is authorized to accept and approve applications for state financing of capital infrastructure improvement project of political subdivisions in Cuyahoga County; and WHEREAS, the City of Lakewood has conducted a capital inventory and needs assessment and has determined that it is necessary and desirable to apply for State Issue Two Infrastructure Bond program funds for funding of the 2006 Clifton Boulevard Improvement Project; and WHEREAS, this Council by a vote of at least five (5) members elected thereto determines that this resolution is an emergency measure, and that this resolution shall take effect at the earliest date possible as set forth in ARTICLE III, SECTONS 10 and 13 of the SECOND AMENDED CHARTER OF THE CITY OF LAKEWOOD, and that it is necessary for the immediate presélVation of the public property, health and safety, and to provide for the usual daily operation of municipal departments in that if this application is not made in a timely manner, the City will lose its opportunity to obtain Issue Two Infrastructure Bond dollars. Now Therefore, BE IT RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO Section 1. That the Mayor, for and on behalf of the City, is hereby authorized to apply to the District One Public Works Integrating Committee and the Director of the Ohio Public Wor~ Commission for financial assistance for the following capital improvement projects: Clifton Boulevard Improvement Project Section 2.
