RESOLUTION <br /> <br />8~?~!-06 BY: Butler, Demro, Dever, <br /> 8078-06 · <br /> FitzGearld, Madigan, Seelie. <br /> <br /> AN EMERGENCY RESOLUTION authorizing and directing the Mayor, on behalf Of the City, to <br />apply for financial assistance under the Northeast Ohio Area Wide Coordinating Agency's (NOACA) <br />Transportation for Livable Communities Initiative (TLCI) Planning Grant Program. <br /> <br /> WHEREAS, NOACA administers financial assistance provided by the U.S. Department of <br />Transportation's Federal H!ghway Administration, and; <br /> <br /> WHEREAS, that section of Detroit Avenue between Arthur and Bunts has been identified as <br />the City of Lakewood's DoWntown District, and; <br /> <br /> WHEREAS, the City of Lakewood's Downtown District has been accepted by Downtown Ohio, <br /> Inc. as one of 34 participants statewide into the Main Street Program, and; <br /> <br /> WHEREAS, the City of Lakew0od would greatly benefit from further study of strategies to <br />improve the pedestrian access and aesthetics of the Downtown District streetscape; and <br /> <br /> WHEREAS, this Council by a vote of at least five (S) members elected thereto determines <br />that this resolution is an emergency measure, and that this resolution shall take ~ffect at the earliest date <br />possible as set forth in ARTICLE III, SECTIONS :[0 and :[3 of the SECOND AMMENDED CHARTER OF THE <br />CiTY OF LAKEWOOD, and that it is necessary for the immediate preservation of the public property, health, <br />and safety, and to provide for the usual daily operation of municipal departments, and that local legislative <br />approval for these funds must be received by NOACA no later than March :[, 2006. Now, therefore, <br /> <br /> BE ~I- ORDAINED BY THE C~TY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section ~. That the Mayor, on behalf of the City, be and is hereby authorized and directed <br />to execute and file an application for Transportation for Livable Communities financial assistamce with <br />NOACA and to provide all information and documentation required to become eligible for possible funding <br />assistance. <br /> <br /> Section 2. That the City of Lakew0od does agree to obligate the funds required to <br />satisfactorily complete the proposed project and become eligible for reimbursement under the terms and <br />Conditions of the Transportation for Livable Communities fund. <br /> <br /> Section 3. It is found and determined that all formal actions of this Council concerning and <br />relating to the passage of this resolution were adopted in an open meeting of this Council, and that all such <br />deliberations of this Council and of any of its committees that resulted in such formal action were in <br />meetings open to the public in compliance with all legal requirements. <br /> <br /> Section 4. That this resolution is hereby declared to be an emergency measure necessary <br />for the usual daily operation of the City for the reasons set forth and defined in the preamble to this <br />ordinance, and provided it receives the affirmative vote of at least five (5) of its members elected to <br />Council, this resolution shall take effect and be in force immediately upon its adoption by the Couhcil and <br />approval by the Mayor otherwise~ it shall take effect and be in force after the earliest period allowed by <br />laW. <br /> <br />President of Council <br /> <br />Clerk ~TCo[Jncif ~f <br /> <br />Approved: <br /> <br /> <br />
