<br />RESOLUTION NO. 8138-06 <br /> <br />PLACED ON 1 ST READING & REFERRED TO THE <br />PUBLIC WORKS COMMITTEE 10/2/06. PLACED ON <br />2ND READING 10/16/06. <br /> <br />BY: Antonio, Butler, Demro, Dever, <br />FitzGerald, Madigan, See lie. <br /> <br />A RESOLUTION to take effect immediately provided it received the affirmative <br />vote of at least five (5) members elected to Council otherwise, It shall take effect and <br />be in force after the earliest period allowed by law, authorizing the Mayor, or his <br />designee, on behalf of the City, to enter into an agreement with Northeast Ohio <br />Areawide Coordinating Agency (NOACA) to accept and expend financial assistance <br />under NOACA's Transportation for Uvable Communities Initiative (TLCI) Planning Grant <br />Program in an amount not to exceed $40,000 for the purpose of conducting further <br />study of the pedestrian access to the Cleveland Metroparks via Hogsback Lane and to <br />enter Into any other necessary agreements to carry out the requirements of the grant <br />agreement and to obtain necessary matching funds. <br /> <br />WHEREAS, Hogsback Lane Serves as a main access point into the Cleveland <br />Metroparks for approximately 2,700 Lakewood households residing in the adjacent <br />neighbòrhoods¡ and <br /> <br />WHEREAS, pedestrian access from the adjacent Lakewood neighborhoods Into <br />the Cleveland Metroparks via Hogsback Lane is hazardous due to Inadequate pedestrian <br />facilities and traffic controls; and <br /> <br />WHEREAS, residents of the City of Lakewood would greatly benefit from further <br />study of public improvements necessary to enable pedestrian access to the Oeveland <br />Metroparks via Hogsback Lane; and <br /> <br />WHEREAS, Northeast Ohio Areawide Coordinating Agency (NOACA) administers <br />financial assistance provided by the U.S. Department of Transportation's Federal <br />Highway Administration, and¡ <br /> <br />WHEREAS, this Council previously approved Resolution No. 8089-06 providing <br />that the Mayor, on behalf of the City, to be authorized and directed to execute and file <br />an application fur Transportation fur Livable Communities financial assistance with <br />NOACA and to provide all Infurmation and documentation required to become eligible <br />for possible funding assistance while obligating the funds required to satisfactorily <br />complete the proposed project and become eligible fur reimbursement under the terms <br />and conditions of the Transportation for Livable Communities fund¡and <br /> <br />WHEREAS, the Oty of Lakewood has been awarded a grant by NOACA in the <br />amount of $32,000 that requires a match of $8,000; and <br /> <br />WHEREAS, Kamms Corner Development Corporation, the Oty of Cleveland, and <br />Oeveland Metroparks Board have agreed to contribute a portion of the City's required <br />matching funds to this project¡ and <br /> <br />WHEREAS, this Council by a vote of at least five (5) members elected thereto <br />determines that this resolution is an emergency measure, and that this resolution shall <br />take effect at the earliest date possible as set forth in ARTICLE III, SECTONS 10 and <br />13 of the SECOND AMENDED CHARTER OF THE CI1Y OF LAKEWOOD, and that it is <br />necessary fur the Immediate preservation of the public property, health and safety, and <br />to provide for the usual daily operation of municipal departments In that these <br />agreements must be returned to the Ohio Public Works Commission within 45 days of <br />notice of award. Now Therefore, <br /> <br />?- <br /> <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, STATE Of OHIO <br /> <br />Section 1. That the Mayor,or his designee, on behalf of the City, is hereby <br />authorized to enter into an agreement with Northeast Ohio Areawide Coordinating <br />
