A RESOLUTION to take effect immediately provided it received the affirmative vote of at least five (5) members elected to Council otherwise, It shall take effect and be in force after the earliest period allowed by law, authorizing the Mayor, or his designee, on behalf of the City, to enter into an agreement with Northeast Ohio Areawide Coordinating Agency (NOACA) to accept and expend financial assistance under NOACA's Transportation for Uvable Communities Initiative (TLCI) Planning Grant Program in an amount not to exceed $40,000 for the purpose of conducting further study of the pedestrian access to the Cleveland Metroparks via Hogsback Lane and to enter Into any other necessary agreements to carry out the requirements of the grant agreement and to obtain necessary matching funds. WHEREAS, Hogsback Lane Serves as a main access point into the Cleveland Metroparks for approximately 2,700 Lakewood households residing in the adjacent neighbòrhoods¡ and WHEREAS, pedestrian access from the adjacent Lakewood neighborhoods Into the Cleveland Metroparks via Hogsback Lane is hazardous due to Inadequate pedestrian facilities and traffic controls; and WHEREAS, residents of the City of Lakewood would greatly benefit from further study of public improvements necessary to enable pedestrian access to the Oeveland Metroparks via Hogsback Lane; and WHEREAS, Northeast Ohio Areawide Coordinating Agency (NOACA) administers financial assistance provided by the U.S. Department of Transportation's Federal Highway Administration, and¡ WHEREAS, this Council previously approved Resolution No. 8089-06 providing that the Mayor, on behalf of the City, to be authorized and directed to execute and file an application fur Transportation fur Livable Communities financial assistance with NOACA and to provide all Infurmation and documentation required to become eligible for possible funding assistance while obligating the funds required to satisfactorily complete the proposed project and become eligible fur reimbursement under the terms and conditions of the Transportation for Livable Communities fund¡and WHEREAS, the Oty of Lakewood has been awarded a grant by NOACA in the amount of $32,000 that requires a match of $8,000; and WHEREAS, Kamms Corner Development Corporation, the Oty of Cleveland, and Oeveland Metroparks Board have agreed to contribute a portion of the City's required matching funds to this project¡ and WHEREAS, this Council by a vote of at least five (5) members elected thereto determines that this resolution is an emergency measure, and that this resolution shall take effect at the earliest date possible as set forth in ARTICLE III, SECTONS 10 and 13 of the SECOND AMENDED CHARTER OF THE CI1Y OF LAKEWOOD, and that it is necessary fur the Immediate preservation of the public property, health and safety, and to provide for the usual daily operation of municipal departments In that these agreements must be returned to the Ohio Public Works Commission within 45 days of notice of award.
