<br />RESOLUTION NO <br /> <br />8154-06 <br /> <br />BY' Antonio, Butler, Demro, Dever, <br />FitzGerald, Madigan, Seelie. <br /> <br />A RESOLUTION opposing the nnfunded mandate by tbe EP A <br /> <br />WHEREAS, the City of Lakewood owns, operates and maintains- its wastewater <br />treatment plant; and, <br /> <br />WHEREAS, the City of Lakewood O\Vl1S and maintains the sewers located <br />therein; and; <br /> <br />WHEREAS, the City has and continnes to make significant upgrades and <br />improvements to both the sewer system and the wastewater treatment plant which has <br />and continues to significantly reduce overflows into Lake Erie; and, <br /> <br />WHEREAS, the EP A is in negotiations with several Ohio cities, including <br />Lakewood, that would require an uncompromising, drastic reconstruction of our current <br />sewer system at an unfathomable cost; and, <br /> <br />WHEREAS, the EP A has and continues to issue these unfunded mandates on <br />municipalities, such as Lakewoo<4 that would dramatically increase sewer rates to <br />citizens; an<4 <br /> <br />and, <br /> <br />WHEREAS, clean and healthy waterways are vital to the Lakewood community; <br /> <br />WHEREAS, the residents of Lakewood have recently had dramatic increases in <br />necessary expenses, including but not limited to,. prescription drugs, natural gas, school <br />levies, gas for automobiles; and, <br /> <br />WHEREAS, the income for many of Lakewood's residents is fixed, and said <br />residents are unable to absorb an increase to their sewer rates, <br /> <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br />Section 1, That the Federal Govenunent and/or the State Government take all <br />necessary steps to institute a more equitable manner of funding the EP A mandate <br /> <br />Section 2. That the EP A unfunded mandate shaIl not be funded by raising the <br />rates of residents who cannot absorb this proposed increase, <br /> <br />Section 3, That the Clerk is hereby directed to forward a copy of this Resolution <br />to any and all state and federal representatives who represent the City of Lakewood, <br />Ohio. <br /> <br />Section 4, That is resolution is hereby declared to be an emergency measure <br />necessary for the immediate preservation of the public peace, property, health, safety, and <br />welfare in the City and for the usual daily operation o(the City for the reasons set forth <br />and defined in the preamble to this resolution, and provided it receives the affinnative <br />vote of at least five (5) of it members elected to Council, this resolution shaH take effect <br />and be in force immediately upon it adoption by the Council and approval by the Mayor <br />otherwise, it shall take effect and be in force after the earliest period allowed by law <br /> <br />AdoPted:)}"'..... /,.- 'it )-dlJt <br /> <br />~,~ <br /> <br />President <br /> <br />Approved: <br /> <br />~t~ <br />~M~ ~ "Zðo6 ~~ ~ <br />, Mayor ik'J-,^l rV14;t"'Z <br />
