RESOLUTION ND. 8223-08 gy; Antonio, Bullock, Butlex, Dever, <br />Madigan, Suers. <br />A RESOLUTION to take effect immediately provided it receives the <br />affirmative vote of at least five (5) members elected to Council otherwise, it shall <br />take effect and be in force after the earliest period allowed by law, authorizing the <br />Mayor, or his designee to enter into a Agreement with The Ohio Tobacco Use <br />Prevention and Control Foundation to accept funds for the City to provide partial <br />funding for enforcement of the SmokeFree Ohio Work Place Act in the City of <br />Lakewood for the period of time commencing December S0, 2007 through March 30, <br />2008. <br />WHEREAS, The Ohio Tobacco Use Prevention and Control Foundation <br />issued a request for proposal for mini grant assistance to local health departments in <br />Ohio to help ensure the successful implementation and enforcement of the <br />SmokeFree Workplace Law, ORC Chapter 3794; and <br />WHEREAS, the Lakewood Department of Human Services/Division of <br />Health was awarded an amount not to exceed $2,642.73 for enforcement activities; <br />and <br />WHEREAS, this Council by a vote of at least five (5) members elected <br />thereto determines that this Resolution is an emergency measure, and that this <br />Resolution shall take effect at the earliest date possible as set forth in ARTICLE III, <br />SECTONS 10 and 13 of the SECOND AMENDED CHARTER OF THE CITY OF <br />LAKEWOOD, and that it is necessary for the immediate preservation of the public <br />property, health and safety, and to provide for the. usual daily operation of municipal <br />departments in that completed contracts must be submitted. no later than December <br />10, 2007. Now Therefore, <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br />Section 1. That the Mayor, or his designee is hereby authorized and <br />directed to enterinto a contract with The Ohio Tobacco Use Prevention and Control <br />Foundation to accept funds not to exceed $2,642.73 for the Department of Human <br />Services/Division of Health to enforce the. SmokeFree Ohio Work Place Act in the City <br />of Lakewood for the period of time commencing December 10, 2007 through March <br />10, 2008. <br />Section 2. It is found and determined that all formal actions of this <br />Council concerning and relating to the passage of this Resolution were adopted in an <br />open meeting of this Council, and that all such deliberations of this Council and of <br />any of its committees that resulted in such forrnal action were in meetings open to <br />the public in compliance with all legal requirements. <br />Section 3. That this Resolution is hereby declared to be an <br />emergency measure necessary for the immediate preservation of the public peace, <br />property, health, safety and welfare in the City and for the usual daily operation of <br />the City for the reasons set forth and defined in the preamble to this ordinance, and <br />provided it receives the affirmative vote of at least five {5) of its members elected to <br />Council, this Resolution shall take effect and be in force immediately upon its <br />adoption by the Council and. approval by the Mayor otherwise, it shall take effect <br />and be in force after the earliest period aflowedby law. <br />Adopted: ~ ~r Zd //~~~~~ ~~- <br />PRESIDENT <br />p CLERK U <br />Approv //, <br />~ MAYOR <br />
