<br />A RESOLUTION to take effect immediately provided it receives the affirmative
<br />vote of at least five (5) members elected to Council otherwise, it shall take effect and be in force
<br />after the earliest period allowed by law, requiring the Mayor to submit a General Fund budget
<br />that does not exceed a value of $36,300,000.
<br />
<br />WHEREAS, the revenues for the General Fund in 2008 are projected to be
<br />$36,500,000, and
<br />
<br />WBEREAS, these revenues have been affirmed by the Auditor of the State of
<br />Ohio as being within a plus or minus factor of two percent (2%), and
<br />
<br />WHEREAS, the City fund balance is nearly depleted, and
<br />
<br />WHEREAS, The City Council, in concert with the Mayor, is required to submit
<br />a budget by March 31 ", 2008, and
<br />
<br />WHEREAS, implementing cost reductions are vital, complicated, and require
<br />the utroost in careful analysis and cooperation from City employees, citizens, and elected leaders,
<br />and
<br />
<br />WHEREAS, a minimal surplus of revenues over expenses is prudent to deal
<br />with unexpected expenses or opportunities; now, therefore,
<br />
<br />WHEREAS, this Council by a vote of at least five (5) members elected
<br />thereto determines that this resolution is an emergency measure, and that this resolution
<br />shall take effect at the earliest date possible as set forth in ARTICLE III, SECTONS 10
<br />and 13 of the SECOND AMENDED CHARTER OF THE CITY OF LAKEWOOD, and
<br />that it is necessary for the immediate preservation of the public property, health and
<br />safety, and to provide for the usual daily operation of municipal departments in that a
<br />balanced budget must be submitted by March 31, 2008. now therefore,
<br />
<br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO:
<br />
<br />SECTION 1. That the Mayor is hereby required to submit a General Fund
<br />budget that does not exceed a value of $36,300,000.
<br />
<br />SECTION 2. That all formal actions of this Council concerning and relating to
<br />the passage of this resolution were adopted in an open meeting of this Council, and that all such
<br />deliberation of the Council and of any of its committees that resulted in such formal action were
<br />in meetings open to the public in compliance with all legal requirements.
<br />
<br />SECTION 3. That this resolution is hereby declared to be an emergency measure
<br />necessary for the immediate preservation of the public peace, property, health, safety and welfare
<br />in the City and for the usual daily operation of the City for the reason set forth and defined in the
<br />preamble, and provided it received the affirmative vote of at least five (5) of its members elected
<br />to Council, this resolution shall take effect and be in force immediately upon its adoption by the
