<br />A RESOLUTION to take effect immediately provided it received the affirmative vote of
<br />at least five (5) members elected to Council otherwise, it shall take effect and be in force after the
<br />earliest period allowed by law objecting to the renewal of the liquor permit for D1, D2, D3, D3A
<br />and D6 liquor permits for 1572 Tavern Inc. D/B/A Bottom's Up for an establishment located at
<br />1572 West 117` St. first floor front and basement, City of Lakewood; Ohio 44107.
<br />WHEREAS, the City has been advised that an application has been filed with the Ohio
<br />Division of Liquor Control to renew the liquor permit the ownership of D 1, D2, D3, D3A and D6
<br />liquor permits for 1572 Tavern Inc D/B/A Bottom's Up, Inc. for an establishment located at 1572
<br />West 117a' St, first floor front and basement, City of Lakewood, Ohio 44107; and
<br />WHEREAS, the City of Lakewood objects to the renewal of the liquor permit for the
<br />reason that the current manager was convicted of a drug related crime relating to his ability to
<br />operate a liquor establishment when on June 18~h, 2008 he pled guilty to possession of drugs, a
<br />felony of the Sa` degree, in Cuyahoga County Case No. 512136; and
<br />WHEREAS, another employee of this same establishment was cited in June, 2008 for
<br />possession of drugs; and
<br />WHEREAS, numerous individuals have been arrested at the premises for possession of
<br />marijuana, possession of hypodermic needles, open container, disorderly conduct intoxicated,
<br />noise violation, underage disorderly conduct intoxicated, and other criminal offenses; and
<br />WHEREAS, the police are often called to that location for noise complaints that disturb
<br />the residential neighbors and neighborhood, and the police respond to complaints of fighting on
<br />the premises. In the past 13 months, the Lakewood Police Department has responded to at least
<br />38 calls for service at this location; and
<br />WHEREAS, the business knowingly operated its establishment while the front door was
<br />broken and inoperable thereby impeding mandatory ingress and egress to the premises
<br />necessitating Lakewood Fire Department to respond to open the door and subsequently pursue
<br />the repair thereof; and
<br />WHEREAS, City Council, after reviewing the evidence from the Police Department,
<br />determines that this establishment has a unfavorable enforcement record, and operation in
<br />disregard for local ordinances, and that the location of the establishment substantially and
<br />adversely interferes with the public decency, sobriety, peace, and good order of the
<br />neighborhood, and the normal, orderly conduct of a public institution; and
<br />WHEREAS, this Council by a vote of at least five (5) members elected thereto
<br />determines that this resolution is an emergency measure, and that this resolution shall take effect
<br />at the earliest date possible as set forth in ARTICLE III, SECTONS 10 and 13 of the SECOND
