RESOLUTION NO.. 8335-09 BY: Antonio, Bullock, Butler, Dever, <br />Madigan, Powers, Summers. <br />A RESOLUTION to take effect immediately provided it receives the affirmative <br />vote of at least five (5) members elected to Councii otherwise, it shall take effect <br />and be in force after the earliest period allowed by law authorizing the City of <br />Lakewood to execute and file an application with the Ohio Department of Natural <br />resources for financial assistance through the Land and Water Conservation <br />Fund (LWCF) Program. <br />WHEREAS, the State of Ohio, through the Department of Natural Resources, <br />administers financial assistance for public recreation purposes through the <br />federally-funded Land and Water Conservation Fund Program; and <br />WHEREAS, the City of Lakewood desires financial assistance under the Land <br />and Water Conservation Fund Program; and <br />WHEREAS, this Council by a vote of at least five (5) members elected thereto <br />determines that this ordinance is an emergency measure, and that this ordinance <br />shall take effect at the earliest date possible as set forth in ARTICLE III, <br />SECTIONS 10 and 13 of the SECOND AMENDED CHARTER OF THE CITY OF <br />LAKEWOOD, and that it is necessary for the immediate preservation of public <br />property, health and safety, and to provide for the usual daily operation of <br />municipal departments in that applications for assistance through the Land and <br />Water Conservation Fund Program are due no later than April 1, 2009. <br />Now Therefore, <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br />Section 1. That the Council of the City of Lakewood approves filing an application <br />for financial assistance. <br />Section 2. That the Director of Public Works is hereby authorized and directed to <br />execute and file an application with the Ohio Department of Natural Resources <br />and to provide all information and documentation required to become eligible for <br />possible funding assistance. <br />Section 3. That the City of Lakewood does agree to obligate the funds required to <br />satisfactorily complete the proposed project and become eligible for <br />reimbursement under the terms of the Land and Water Conservation Fund <br />Program. <br />
