REFERRED TO THE COMMITTEE OF THE WHOLE 5/4/09. RESOLUTION N0. 8348-09 BY: Antonio, Bullock, Butler, Dever, Madigan, Powers, Summers. A RESOLUTION to take effect immediately provided it receives the affirmative vote of at least five (5) members elected to Council otherwise, it shall take effect and be in force after the earliest period allowed by law authorizing the City of Lakewood to adopting an Identity Theft Prevention Program, WHEREAS, The Fair and Accurate Credit Transactions Act of 2003 (FACIA), an amendment to the Fair Credit Reporting Act, required rules regarding identity theft protection to be promulgated; and WHEREAS, Those rules were to become effective. November 1, 2008,. and require municipal utilities and other departments to implement an identity theft prevention program; and WHEREAS, The Federal Trade Commission granted a six month extension to May 1, 2009 to give additional time in which to develop and implement written identity theft prevention procedures and programs; and WHEREAS, The City of Lakewood has determined that the policy attached hereto as Exhibit A is in the best interest of the municipality ahd its citizens; and WHEREAS, this Council by a vote of at least five (5) members elected thereto determines that this ordinance is an emergency measure, and that this. ordinance shall take effect at the earliest date possible as set forth in ARTICLE III, SECTONS 10 and 13 of the SECOND AMENDED CHARTER OF THE CITY OF ~KEWOOD, and that it is necessary to .provide for the usual daily operation of the City in that the. Fair and Accurate Credit Transactions Act of 2003 (FACIA} requires rules regarding identity theft protection to be promulgated. Now Therefore, BE IT RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That the Council of the City of Lakewood approves the Identity Theft Prevention Program attached hereto as Exhibit A is hereby adopted.
