REFERRED TO THE COMMITTEE OF THE <br />WHOLE 5/4/09. <br />RESOLUTION N0. 8348-09 BY: Antonio, Bullock, Butler, Dever, <br />Madigan, Powers, Summers. <br />A RESOLUTION to take effect immediately provided it receives the affirmative <br />vote of at least five (5) members elected to Council otherwise, it shall take effect and <br />be in force after the earliest period allowed by law authorizing the City of Lakewood to <br />adopting an Identity Theft Prevention Program, <br />WHEREAS, The Fair and Accurate Credit Transactions Act of 2003 (FACIA), an <br />amendment to the Fair Credit Reporting Act, required rules regarding identity theft <br />protection to be promulgated; and <br />WHEREAS, Those rules were to become effective. November 1, 2008,. and require <br />municipal utilities and other departments to implement an identity theft prevention <br />program; and <br />WHEREAS, The Federal Trade Commission granted a six month extension to May <br />1, 2009 to give additional time in which to develop and implement written identity theft <br />prevention procedures and programs; and <br />WHEREAS, The City of Lakewood has determined that the policy attached hereto <br />as Exhibit A is in the best interest of the municipality ahd its citizens; and <br />WHEREAS, this Council by a vote of at least five (5) members elected thereto <br />determines that this ordinance is an emergency measure, and that this. ordinance shall <br />take effect at the earliest date possible as set forth in ARTICLE III, SECTONS 10 and <br />13 of the SECOND AMENDED CHARTER OF THE CITY OF ~KEWOOD, and that it is <br />necessary to .provide for the usual daily operation of the City in that the. Fair and <br />Accurate Credit Transactions Act of 2003 (FACIA} requires rules regarding identity theft <br />protection to be promulgated. <br />Now Therefore, <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br />Section 1. That the Council of the City of Lakewood approves the Identity Theft <br />Prevention Program attached hereto as Exhibit A is hereby adopted. <br />
