RESOLUTION $372-A-09 B~(; Antonio, Bullock, Butler, Dever, Madigan, Powers, Summers. RESOLUTION to take effect immediately provided it receives the affirmative vote of at least five (5) members elected to Council otherwise, it shall take effect and be in force at the earliest period allowed by law, authorizing and directing the Mayor, on behalf of the City, to apply for financial assistance under the Northeast Ohio Areawide Coordinating Agency's (NOACA) Transportation for Livable Communities Initiative (TLCI) Planning Grant Program. WHEREAS, NOACA administers financial assistance provided by the U.S. Department of Transportation's Federal Highway Administration; -and WHEREAS, the eastern end of Madison Avenue serves as an important corridor for residents of the adjacent neighborhoods, and for people visiting and passing through this area of the City; and WHEREAS, residents of the City of Lakewood would greatly benefit from further study of strategies to improve the pedestrian access, traffic movement, and the streetscape of Madison Avenue in this eastern end neighborhood; and WHEREAS, this Council by a vote of at least five (5) members elected thereto determines that this resolution is an emergency measure, and that this resolution shall take effect at the earliest date possible as set forth in ARTICLE III, SECTIONS 10 and 13 of the SECOND AMMENDED CHARTER OF THE CITY OF LAKEWOOD, and that it is necessary for the immediate preservation of the public property, health, and safety; and to provide for the usual daily operation of municipal departments, and that local legislative approval to apply for these funds must be received by NOACA no later than November 19, 2009. Now, therefore, BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That the Mayor, on behalf of the City, be and is hereby authorized and directed to execute and file an application for Transportation for Livable Communities financial assistance with NOACA and to provide all information and documentation required to become eligible for possible funding assistance. Section 2. That the City of Lakewood does agree to obligate the funds required to satisfactorily complete the proposed project and become eligible for reimbursement under the terms and conditions of the Transportation for Livable Communities fund. Section 3. It is found and determined that all formal actions of this Council concerning and relating to the passage of this resolution were adopted in an open meeting of this Council, and that all such deliberations of this Council and of any of its committees that resulted in such formal action were in meetings open to the public in compliance with all legal requirements. Section 4. That this resolution is hereby declared to be an emergency measure necessary for the usual daily operation of the City for the reasons set forth and defined in the preamble to this ordinance, and provided it receives the affirmative vote of at least five (5) of its
