RESOLUTION $372-A-09 B~(; Antonio, Bullock, Butler, Dever, Madigan, <br />Powers, Summers. <br />RESOLUTION to take effect immediately provided it receives the affirmative vote of at <br />least five (5) members elected to Council otherwise, it shall take effect and be in force at the earliest <br />period allowed by law, authorizing and directing the Mayor, on behalf of the City, to apply for <br />financial assistance under the Northeast Ohio Areawide Coordinating Agency's (NOACA) <br />Transportation for Livable Communities Initiative (TLCI) Planning Grant Program. <br />WHEREAS, NOACA administers financial assistance provided by the U.S. Department of <br />Transportation's Federal Highway Administration; -and <br />WHEREAS, the eastern end of Madison Avenue serves as an important corridor for <br />residents of the adjacent neighborhoods, and for people visiting and passing through this area of the <br />City; and <br />WHEREAS, residents of the City of Lakewood would greatly benefit from further study <br />of strategies to improve the pedestrian access, traffic movement, and the streetscape of Madison <br />Avenue in this eastern end neighborhood; and <br />WHEREAS, this Council by a vote of at least five (5) members elected thereto <br />determines that this resolution is an emergency measure, and that this resolution shall take effect at <br />the earliest date possible as set forth in ARTICLE III, SECTIONS 10 and 13 of the SECOND <br />AMMENDED CHARTER OF THE CITY OF LAKEWOOD, and that it is necessary for the immediate <br />preservation of the public property, health, and safety; and to provide for the usual daily operation of <br />municipal departments, and that local legislative approval to apply for these funds must be received <br />by NOACA no later than November 19, 2009. Now, therefore, <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br />Section 1. That the Mayor, on behalf of the City, be and is hereby authorized and <br />directed to execute and file an application for Transportation for Livable Communities financial <br />assistance with NOACA and to provide all information and documentation required to become eligible <br />for possible funding assistance. <br />Section 2. That the City of Lakewood does agree to obligate the funds required to <br />satisfactorily complete the proposed project and become eligible for reimbursement under the terms <br />and conditions of the Transportation for Livable Communities fund. <br />Section 3. It is found and determined that all formal actions of this Council concerning <br />and relating to the passage of this resolution were adopted in an open meeting of this Council, and <br />that all such deliberations of this Council and of any of its committees that resulted in such formal <br />action were in meetings open to the public in compliance with all legal requirements. <br />Section 4. That this resolution is hereby declared to be an emergency measure <br />necessary for the usual daily operation of the City for the reasons set forth and defined in the <br />preamble to this ordinance, and provided it receives the affirmative vote of at least five (5) of its <br />
