REFERRED'"TOPTHEERUBLIC WORKS COMMITTEE 2/16/10. <br />RESOLUTION N0. $403-10 BY: Antonio, Bullock, Butler, Madigan, <br />Powers, Smith, Summers. <br />AN EMERGENCY RESOLUTION authorizing the Mayor to enter into an agreement <br />with the Northeast Ohio Area Coordinating Agency (NOACA) to accept and expend <br />funds in the amount of $50,000 for the Transportation for Livable Communities Program <br />for Madison Avenue. <br />WHEREAS, the funds from this grant will be used to fund the Madison East <br />Project which is a study of strategies to improve pedestrian access, traffic movement, <br />and the streetscape of Madison Avenue in that are of the City of Lakewood bordered by <br />Madison Avenue. to the north, Clarence Avenue to the west, Bramley Avenue and the <br />Greater Cleveland RTA Rapid Tracks to the south and West 117"' Street to the east; and <br />WHEREAS, thPs Council by a vote of at least five (5) members elected thereto <br />determines that this resolution is an emergency measure, and that this resolution shall <br />take effect at the earliest date possible as set forth in ARTICLE III, SECTONS 10 and 13 <br />of the SECOND AMENDED CHARTER OF THE CITY OF LAKEWOOD, and that it is <br />necessary for the immediate preservation of the public property, health and safety, and <br />to provide for the usual daily operation of municipal departments in that this agreement <br />should be formalized immediately. Now Therefore, <br />BE 1T RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO <br />Section 1. The Mayor is hereby authorized to enter into an agreement with <br />the Northeast Ohio Area Coor~nating Agency (NOACA) to accept and expend funds in <br />the amount of $50,000 for the Transportation for Livable Communities Program for <br />Madison Avenue. <br />Section 2. It is found and determined that all formal actions of this Council <br />concerning and relating to the passage of this resolution were adopted in an open <br />meeting of this council, and that all such deliberations of this Council and any of its <br />committees that resulted in such formal action, were in meetings open to the public, in <br />compliance with all legal requirements. <br />Section 4. That this resolution is hereby declared to be an emergency <br />measure necessary for the immediate preservation of the public peace, property, <br />
