AMENDED ON Tf~IE FLOOR 6/7/10 RESOLUTION NO. 8423-10 BY: Antonio, Bullock, Butler, Madigan, Powers, Smith, Summers. A RESOLUTION to take effect immediately provided it receives the affirmative vote of at least five (5) members elected to Council otherwise, it shall take effect and be in force after the earliest period allowed by law, changing the date of the September 6, 2010 Lakewood City Council meeting to Wednesday, September 8, 2010 at 7:30 p.m. due to a scheduling conflict with the primary election to be held Tuesday, September 7, 2010. WHEREAS, Monday, September 6, 2010 is a legal holiday in recognition of Labor Day; and WHEREAS, by operation of law, any regularly scheduled Council meeting that falls on a holiday is moved to the next day pursuant to Lakewood Codified Ordinance 121.03(b) and the Second Amended Charter of the City of Lakewood, Article III, §4; and WHEREAS, Tuesday, September 7, 2010 is a primary election day within the City of Lakewood for which the Cuyahoga County Board of Elections has requested use of the City Hall Auditorium which also serves as Council Chambers; and WHEREAS, Lakewood Codified Ordinance § 121.02 pernuts Council, by two- thirds vote of the members elected thereto, to suspend the operation of any rule as to any meeting; and WHEREAS, this Council by a vote of at least five (5) members elected thereto determines that this resolution is an emergency measure, and that this resolution shall take effect at the earliest date possible as set forth in ARTICLE III, SECTONS 10 and 13 of the SECOND AMENDED CHARTER OF THE CITY OF LAKEWOOD and that it is necessary for the immediate preservation of the public property, health and safety, and to provide for the usual daily operation of municipal departments in that notice of the change in the first meeting in the month of September of Lakewood City Council should be provided immediately to the public and news media; now, therefore, BE IT RESOLVED BY THE CITY OF LAKEWOOD, STATE QF OHIO: Section 1. The September 6, 2010 meeting of the Lakewood City Council shall beheld in Council Chambers on Wednesday, September 8, 2010 at 7:30 p.m. Section 2. That the Clerk of Council shall give notice of this meeting to any news media requesting such notification and shall conspicuously post such nofice in posting places established in the Lakewood Codified Ordinance §107.01 upon adoption of this resolution.
