PLACED ON 1ST READING & REFERRED TO THE <br />COMMITTEE OF THE WHOLE 5/16/11. <br />SECOND READING 6/6/11. <br />RESOLUTION NO. 8496-11 gy; Anderson, Bullock, Madigan, Nowlin, <br />Powers, Smith. <br />A RESOLUTION to take effect immediately provided it receives the affirmative vote of at least five <br />(S) members of Council, or otherwise to take effect and be in force after the earliest period allowed by <br />law, opposing Senate Bill 5, a proposed state law that would unnecessarily and damagingly rewrite Ohio's <br />collective bargaining law. <br />WHEREAS, Senate Bill 5 (S.B. 5) seeks to rewrite Ohio's collective bargaining law; and <br />WHEREAS, as originally introduced, S.B. 5 would ban collective bargaining for all state <br />employees and sharply curtail binding arbitration rules for local governments; and <br />WHEREAS, Lakewood has experienced the existing binding arbitration rules to the satisfaction of <br />all parties, and our relationships with all our bargaining units are positive and cooperative under these <br />circumstances; and <br />WHEREAS, this Council understands that 61% of Americans oppose measures such as S.B. 5; <br />and <br />WHEREAS, this Council believes that the serious budget crisis facing the state should not be used <br />as an excuse to eliminate the long-established collective bargaining rights of hardworking public servants; <br />and <br />WHEREAS, the City of Lakewood has shown that a more effective way of addressing economic <br />crisis is to openly engage workers and negotiate at the bargaining table; and <br />WHEREAS, several provisions of S.B. 5 are redundant or unnecessary or do not apply to <br />Lakewood city government including no strike provisions, accruals for vacation, sick and holiday leave <br />that are less restrictive than our local agreements, pension pickup agreements, and <br />WHEREAS, several provisions of S.B. 5 are damaging, since the shift of binding arbitration to City <br />Council will have the unintended effect of politicizing labor negotiations and Council's role in them; and <br />WHEREAS, this administration and council believe there are opportunities to reform collective <br />bargaining in Ohio to the advantage of Lakewood's citizens and public and private workforce, but S.B. 5 <br />goes far afield of what is appropriate reform <br />WHEREAS, this resolution constitutes an emergency measure for the immediate preservation of <br />public peace, property, health or safety, now, therefore, <br />BE IT RESOLVED BY CITY OF LAKEWOOD, STATE OF OHIO: <br />Section i. This Council hereby objects to Senate Bill 5, which would eliminate collective <br />bargaining for state employees and reform collective bargaining rules for local government employees. <br />Section 2. The Clerk of Council is hereby directed to forward a copy of this resolution to <br />Governor John Kasich and all members of the Ohio Senate and House of Representatives. <br />Section 3. It is found and determined that all formal actions of this Council concerning and <br />relating to the passage of this resolution were adopted in an open meeting of this Council, and that all <br />such deliberations of this Council and of any of its committees that resulted in sueh formal action were in <br />meetings open to the public in compliance with all legal requirements. <br />
