REFERRED TO THE I?V&XCESAgE�YT %OTE. <br />4/7/14. <br />RESOLUTIONNO, 8733714 BY: Andreson, Bullock, Juris, Madigan, <br />Marx, Nowlin, O'Leary. <br />A RESOLUTION to take effect immediately provided it receives the affirmative vote of <br />at least five members of Council, or otherwise to take effect and be in force after the earliest pe- <br />riod allowed by law, to authorize the Mayor, as Director of Public Safety, to enter into an agree- <br />ment between the Cities of Lakewood and Rocky River and the Board of Park Commissioners of <br />the Cleveland Metropolitan Park District for the interchange of public safety and marine police <br />patrol services. <br />WHEREAS, the Cities of Lakewood and Rocky River and the Board of Park Commis- <br />sioners of the Cleveland Metropolitan Park District wish to allow all park district police and law <br />enforcement officers to perform any police function, exercise any police power, or render any <br />police service within the jurisdiction of any of the contracting subdivisions; and <br />WHEREAS, Ohio Revised Code §737.04 provides authority for municipalities and polit- <br />ical subdivisions to contract for the interchange of police services; and <br />WHEREAS, in order to collaboratively provide police protection and reduce crime, it is <br />the desire of the parties to this agreement to provide for and join in providing for mutual assis- <br />tance and the interchange of their respective personnel and equipment; and <br />WHEREAS, pursuant to the Constitution of the State of Ohio and the Ohio Revised <br />Code, municipalities have the power of local self - government; and <br />WHEREAS, pursuant to the Constitution of the State of Ohio and the Ohio Revised <br />Code, municipalities have the power to enact laws that are for the health, safety, welfare, comfort <br />and peace of the citizens of the municipality; and <br />WHEREAS, this Council by a vote of at least five of its members determines that this <br />resolution is an emergency measure, and that this resolution shall take effect at the earliest date <br />possible as set forth in Article III, Sections 10 and 13 of the Second Amended Charter of the City <br />of Lakewood, and that it is necessary for the immediate preservation of the public property, <br />health and safety, and to provide for the usual daily operation of municipal departments in that <br />this agreement is necessary to immediately provide for mutual aid between the party subdivi- <br />sions; now, therefore <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, OHIO: <br />Section 1. The Mayor, as Director of Public Safety, is authorized to execute an agree- <br />ment between the Cities of Lakewood and Rocky River and the Board of Commissioners of the <br />Cleveland Metropolitan Park District for the interchange of public safety and marine patrol ser- <br />vices in substantially the same form as the agreement attached as Exhibit A. <br />Section 2.
