RESOLUTION NO. 8737 -14 BY: Anderson, Bullock, Juris, Madigan, Marx, Nowlin, O'Leary. A RESOLUTION to take effect immediately provided it receives the affirmative vote of at least five members of Council, or otherwise to take effect and be in force after the earliest period allowed by law, authorizing the Director of Public Works to file an application for Coastal Management Assistance with the Ohio Department of Natural Resources, Office of Coastal Management and to enter into any necessary agreements to accept funds awarded. WHEREAS, the city of Lakewood desires financial assistance under the Coastal Management Assistance Grant Program; and WHEREAS, fiords, if awarded, would be used to develop a comprehensive plan for coastal erosion and storm water management; and WHEREAS, this Council by a vote of at least five of its members determines that this resolution is an emergency measure, and that this resolution shall take effect at the earliest date possible as set forth in Article III, Sections 10 and 13 of the Second Amended Charter of the City of Lakewood, and that it is necessary for the immediate preservation of the public property, health and safety, and to provide for the usual daily operation of municipal services, in that this application must be filed by November 21, 2014 in order to receive consideration; now, therefore BE IT RESOLVED BY THE CITY OF LAKEWOOD, OHIO: Section 1. The Council of the city of Lakewood approves filing an application for Coastal Management Assistance Grants financial assistance. Section 2. The Director of Public Works is hereby authorized to execute and file an application with the Ohio Department of Natural Resources and to provide all information and documentation required to become eligible for possible funding assistance. Section 3. The Director of Public Works is hereby authorized to execute and file any agreements necessary to accept an award of financial assistance from the Ohio Department of Natural Resources, Office of Coastal Management. Section 4. The city of Lakewood agrees to obligate finds required to satisfactorily complete the proposed project and become eligible for reimbursement under the terms and conditions of the Coastal Management Assistance Grants Program. Section S. It is found and determined that all formal actions of this Council concerning and relating to the passage of this resolution were adopted in an open meeting of this Council, and that all such deliberation of the Council and of any of its committees that resulted in such formal action were in meetings open to the public in compliance with all legal requirements.
