RESOLUTION NO. 8743 -14 BY: Anderson, Bullock, Juris, Madigan, Marx, Nowlin, O'Leary. A RESOLUTION to take effect immediately provided it receives the affirmative vote of at least five members of Council, or otherwise to take effect and be in force after the earliest period allowed by law, authorizing the Mayor to enter into an agreement with Cuyahoga County, Ohio, and any other agreements with the County necessary to complete the planning and construction of the improvement of a portion of public highway located within the City described as the roadway rehabilitation of W. 117 °i Street from Bellaire Road to Lake Avenue, in an amount not to exceed $150,000. WHEREAS, the City has recognized the need for and proposes the improvement of a portion of public highway, located within the City, which is described as the roadway rehabilitation of W. 117 °i Street from Bellaire Road to Lake Avenue; and WHEREAS, pursuant to the Constitution of the State of Ohio and the Ohio Revised Code, municipalities have the power of local self - government, and the power to enact laws that are for the health, safety, welfare, comfort and peace of the citizens of the municipality; and WHEREAS, this Council by a vote of at least five members thereof determines that this resolution is an emergency measure, and that this resolution shall take effect at the earliest date possible as set forth in Article III, Sections 10 and 13 of the Second Amended Charter of the City of Lakewood, and that it is necessary for the immediate preservation of the public property, health and safety, and to provide for the usual daily operation of municipal departments and for the scheduling of street improvement project; now, therefore BE IT RESOLVED BY THE CITY OF LAKEWOOD, OHIO: Section 1. The Mayor is authorized and directed on behalf of the City to enter into an agreement with Cuyahoga County, Ohio, in substantially the same form as that attached to this resolution as Exhibit A, and any other agreements with the County necessary to complete the planning and construction of the improvement of a portion of public highway located within the City described as the roadway rehabilitation of W. 117 °i Street from Bellaire Road to Lake Avenue, in an amount not to exceed $150,000. Section 2. The Mayor is hereby empowered and directed on behalf of the City to make application to the County for approval to use Comity Motor Vehicle License Tax Funds for the improvement. Section 3. It is found and determined that all formal actions of this Council concerning and relating to the passage of this resolution were adopted in an open meeting of this Council, and that all such deliberation of the Council and of any of its committees that resulted in such formal action were in meetings open to the public in compliance with all legal requirements.
