RESOLUTION NO. 8743 -14 BY: Anderson, Bullock, Juris, Madigan, <br />Marx, Nowlin, O'Leary. <br />A RESOLUTION to take effect immediately provided it receives the affirmative vote of <br />at least five members of Council, or otherwise to take effect and be in force after the earliest <br />period allowed by law, authorizing the Mayor to enter into an agreement with Cuyahoga County, <br />Ohio, and any other agreements with the County necessary to complete the planning and <br />construction of the improvement of a portion of public highway located within the City described <br />as the roadway rehabilitation of W. 117 °i Street from Bellaire Road to Lake Avenue, in an <br />amount not to exceed $150,000. <br />WHEREAS, the City has recognized the need for and proposes the improvement of a <br />portion of public highway, located within the City, which is described as the roadway <br />rehabilitation of W. 117 °i Street from Bellaire Road to Lake Avenue; and <br />WHEREAS, pursuant to the Constitution of the State of Ohio and the Ohio Revised <br />Code, municipalities have the power of local self - government, and the power to enact laws that <br />are for the health, safety, welfare, comfort and peace of the citizens of the municipality; and <br />WHEREAS, this Council by a vote of at least five members thereof determines that this <br />resolution is an emergency measure, and that this resolution shall take effect at the earliest date <br />possible as set forth in Article III, Sections 10 and 13 of the Second Amended Charter of the City <br />of Lakewood, and that it is necessary for the immediate preservation of the public property, <br />health and safety, and to provide for the usual daily operation of municipal departments and for <br />the scheduling of street improvement project; now, therefore <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, OHIO: <br />Section 1. The Mayor is authorized and directed on behalf of the City to enter into an <br />agreement with Cuyahoga County, Ohio, in substantially the same form as that attached to this <br />resolution as Exhibit A, and any other agreements with the County necessary to complete the <br />planning and construction of the improvement of a portion of public highway located within the <br />City described as the roadway rehabilitation of W. 117 °i Street from Bellaire Road to Lake <br />Avenue, in an amount not to exceed $150,000. <br />Section 2. The Mayor is hereby empowered and directed on behalf of the City to make <br />application to the County for approval to use Comity Motor Vehicle License Tax Funds for the <br />improvement. <br />Section 3. It is found and determined that all formal actions of this Council concerning <br />and relating to the passage of this resolution were adopted in an open meeting of this Council, <br />and that all such deliberation of the Council and of any of its committees that resulted in such <br />formal action were in meetings open to the public in compliance with all legal requirements. <br />
