Recommended for adoption <br />as amended 5/2/2016. <br />RESOLUTIONNO. 8861 -16 BY: Anderson, Bullock, Litten, Marx, <br />O'Leary, O'Malley. <br />A RESOLUTION to take effect immediately provided it receives the vote of at least <br />five members of Council, or otherwise to take effect at the earliest period allowed by law, creat- <br />ing the Volunteer Peace Officer Dependent Fund Board for the purpose of assisting in the re- <br />view and determination of validity of claims made under the Volunteer Peace Officer Depend- <br />ent Fund established by ORC Chapter 143 for death or disability of a volunteer peace officer; <br />and naming two appointees to the board. <br />WHEREAS, Ohio Revised Code Chapter 143 will become effective on March 23, 2016; <br />and <br />WHEREAS, Ohio Revised Code Chapter 143 requires that any local government which <br />employs volunteer peace officers participate in a newly established Volunteer Peace Officer <br />Dependent Fund (the "Fund ") in order to establish a process of submitting and paying claims <br />for injuries of volunteer officers resulting in death or disability; and <br />WHEREAS, Chapter 143 of the Ohio Revised Code also requires that participating gov- <br />ernments establish a Board to accept and determine eligibility of claims made under the Fund; <br />and <br />WHEREAS, the Revised Code established a five member Board serving one -year terms <br />with two members appointed by the legislative authority, two members elected by the volunteer <br />peace officers of the police or sheriffs department and one member elected by the four mem- <br />bers above; and <br />WHEREAS, each board member must be an elector of the city, but cannot be a public <br />employee, member of the legislative authority, or peace officer of the city; and <br />WHEREAS, this Council by a vote of at least five of its members determines that this <br />resolution is an emergency measure and that it shall take effect at the earliest date possible as <br />set forth in Article III, Sections 10 and 13 of the Second Amended Charter of the City of Lake- <br />wood and that it is necessary for the immediate preservation of the public property, health, and <br />safety and to provide for the usual daily operation of municipal departments in that the City is <br />required to establish a Board no later than April 22, 2016; now, therefore, <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, OHIO: <br />Section 1. Council hereby establishes the Volunteer Peace Officer Dependent Fund <br />Board for the purpose of assisting in the review and determination of validity of claims made <br />
