REFERRED TO COMMITTEE OF THE WHOLE <br />5/16/16. <br />RESOLUTION NO. 8869 -16 BY: Anderson, Bullock, Litten, Marx,, <br />Nowlini O'Leary, O'Malley. <br />A RESOLUTION to take effect immediately provided it receives the affirmative vote of <br />at least five members of Council, or otherwise to take effect and be in force after the earliest pe- <br />riod allowed by law, authorizing the Mayor to enter into a lease agreement with Lakewood Child <br />Care Center for the lease of the real property located at 1450 Belle Avenue, Suite 100, also <br />known as the Community Health Center. <br />WHEREAS, the City is the owner of real property located at 1450 Belle Avenue, known <br />as the Community Healthcare Center; and <br />WHEREAS, Suite 100 of that property is currently occupied subject to a long term lease <br />for that suite expires August 31, 2016; and <br />WHEREAS, this Council has determined it is in the best interest of the City to renew its <br />leasehold relationship with the Lakewood Child Care Center to further the interest of the City <br />and its residents; and <br />WHERAS, this Council by a vote of at least five of its members determines that this reso- <br />lution is an emergency measure, and that this resolution shall take effect at the earliest date pos- <br />sible as set forth in Article III, Sections 10 and 13 of the Second Amended Charter of the City of <br />Lakewood, and that it is necessary for the immediate preservation of the public property, health <br />and safety, and to provide for the usual daily operation of municipal department in that the lease <br />governing this suite will soon expire; now, therefore, <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, OHIO: <br />Section 1. The Mayor is hereby authorized, on behalf of the City, to enter into a lease <br />agreement with The Lakewood Child Care Center for the lease of the real property located at <br />1450 Belle Avenue, Ste. 100 also known as the Community Health Center, in substantially the <br />same form as Exhibit A. <br />Section 2. All provisions of the Codified Ordinances with respect to the sale or lease of <br />City -owned property are deeded to have been met or superseded by this ordinance inasmuch as <br />those provisions apply to the lease of real property contemplated in the agreement. <br />Section 3. To the extent that this resolution is inconsistent with any other ordinance or <br />resolution previously adapted by Council with respect to the purchase of property by the city or <br />the sale or lease of property owned by the City, this ordinance is meant to and shall supersede <br />such previously- adopted legislation. <br />
