RESOLUTION NO. 8876 -16 BY: Anderson, Bullock, Litten, ,Marx, <br />Nowlin, O'Leary, O'Malley. <br />A RESOLUTION to take effect immediately provided it receives the affirmative vote of <br />at least five members of Council, or otherwise to take effect and be in force after the earliest <br />period allowed by law, authorizing the Purchasing Manager to purchase Fitbit devices without <br />the necessity of bidding in accordance with Lakewood Codified Ordinance §I I1.04(a)(10) in <br />accordance with the City of Lakewood standard purchase order terms and conditions. <br />WHEREAS, the City of Lakewood has kicked off Be Well, Lakewood, an employee <br />wellness program; and <br />WHEREAS, a recommendation was made from the wellness committee to offer <br />employees electronic health monitoring devices at a reduced cost; and <br />WHEREAS, competitive pricing has been obtained directly from Fitbit, Inc. with the <br />purchase of a quantity of 150 devices; and <br />WHEREAS, it is in the best interest of the City to purchase these devices without bidding <br />in order to make them available to employees as soon as possible and not incur the expense of <br />the bidding process; and <br />WHEREAS, this Council by a vote of at least five of its members determines that this <br />resolution is an emergency measure, and that this resolution shall take effect at the earliest date <br />possible as set forth in Article III, Sections 10 and 13 of the Second Amended Charter of the City <br />of Lakewood, and that it is necessary for the immediate preservation of the public property, <br />health and safety, and to provide for the usual daily operation of municipal departments in order <br />to take advantage of this competitive pricing before the quote expires; now, therefore <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, OHIO: <br />Section 1. Council hereby determines that it is impractical to award the purchase of <br />electronic health monitoring devices under competitive bidding procedures, and that it is more <br />cost - effective and in the best interests of the City to award the contract without competitive <br />bidding, and thus authorizes the Purchasing Manager to award a contract to Fitbit, Inc. for the <br />purchase of Fitbit devices. <br />Section 2. Council specifically approves the quote provided by Fitbit, Inc. attached as <br />Exhibit A, together with the City of Lakewood's standard purchase order, as the contract for this <br />matter. <br />Section 3. It is found and determined that all formal actions of this Council concerning <br />and relating to the passage of this resolution were adopted in an open meeting of this Council, <br />
