RESOLUTION NO. 8933 -17 BY: Anderson, Bullock, Litten, Marx, Nowlin, O'Leary, O'Malley. A RESOLUTION to take effect immediately provided it received the affirmative vote of at least five members of Council, or otherwise to take effect and be in force after the earliest period allowed by law, authorizing the Mayor (Director of Public Safety), on behalf of the City of Lakewood, is hereby authorized to donate up to eight abandoned bicycles, that would otherwise be scrapped, for reconditioning and distribution through the H2O program that is supported by their annual fundraiser, Bikes and Bands. WHEREAS, the Lakewood Division of Police annually collects hundreds of bicycles that are abandoned; and WHEREAS, some of the bicycles have value and are auctioned through an on -line auction process; and WHEREAS, many of the bicycles are scrapped due to the bike having a higher value as scrap than it will receive through auction; and WHEREAS, the Lakewood Police Department is in possession of numerous abandoned bicycles that are of little value if disposed of through traditional auctions but are in good enough condition that they could be reconditioned and distributed within the community to families in need of bicycles; and WHEREAS, this Council by a vote of at least five of its members determines that this resolution is an emergency measure, and that this resolution shall take effect at the earliest date possible as set forth in Article III, Sections 10 and 13 of the Second Amended Charter of the City of Lakewood, and that it is necessary for the immediate preservation of the public property, health and safety, and to provide for the usual daily operation of municipal departments in that the annual Bikes and Bands fundraiser was held on May 7, 2017; now, therefore, BE IT RESOLVED BY THE CITY OF LAKEWOOD, OHIO: Section 1. The Mayor (Director of Public Safety), on behalf of the City of Lakewood, is hereby authorized to give away up to eight abandoned bicycles that would otherwise be auctioned for reconditioning and distribution through the H2O program that is supported by their annual fundraiser, Bikes and Bands, and Council ratifies any prior donations of such bicycles to the city sponsored Help to Others program (H20). Section 2. It is found and determined that all formal actions of this Council concerning and relating to the passage of this resolution were adopted in an open meeting of this Council, and that all such deliberations of this Council and of any of its committees
