REFERRED TO THE PUBLIC WORKS COMMITTEE <br />9/5/17. <br />RESOLUTION NO. 8949 -17 BY: Anderson,,, Bullock, Litten, Marx, <br />Nowlin, O'Leary, O'Malley. <br />A RESOLUTION to take effect immediately provided it receives the affirmative vote of at <br />least five members of council, or otherwise to take effect at the earliest period allowed by law, <br />authorizing the Mayor of the City of Lakewood, or his designee, to prepare and submit an <br />application to participate in the Ohio Public Works Commission State Capital Improvement <br />Program, Local Transportation Improvement Program or any other appropriate Ohio Public Works <br />Commission program that these projects qualify for and to execute contracts as required. <br />WHEREAS, both the State Capital Improvement Program and the Local Transportation <br />Improvement Program provide financial assistance to political subdivisions for capital <br />improvements to public infrastructure; and <br />WHEREAS, The City of Lakewood is planning to make capital improvements to the <br />wateimains and sewer system at Lake Avenue and Lakewood Heights Boulevard as well as the <br />construction of a new high rate waste water treatment facility; and <br />WHEREAS, the infrastructure improvements described above are considered to be a priority <br />need for the community and are qualified projects under the OPWC programs; and <br />WHEREAS, Article 18, Section 3 of the Constitution of the State of Ohio permits <br />municipalities to exercise all powers of local self - government and to adopt and enforce within their <br />limits such as local police, sanitary and other regulations as are not in conflict with general laws; <br />and <br />WHEREAS, this Council by a vote of at least five of its members determines that this <br />resolution is an emergency measure, and that this resolution shall take effect at the earliest date <br />possible as set forth in Article I1I, Sections 10 and 13 of the Second Amended Charter of the City of <br />Lakewood, and that it is necessary to provide for the usual daily operation of municipal departments <br />in that the OPWC application deadline is October 5, 2017; now, therefore <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, OHIO: <br />Section 1. The Mayor of the City of Lakewood, or his designee, is hereby authorized to <br />prepare and submit an application to participate in the Ohio Public Works Commission State <br />Capital Improvement Program, Local Transportation Improvement Program, or any other Ohio <br />Pubic Works Commission finding program that these projects qualify for. <br />Section 2. The Mayor, the Director of Public Works, Director of Law and the Director of <br />Finance for the City of Lakewood are authorized to enter into any agreements as may be necessary <br />and appropriate for obtaining this financial assistance. <br />
