REFERRED TO THE COMMITTEE OF THE WHOLE <br />5/7/18. <br />RESOLUTION NO. 9000 -18 BY; Anderson, Bullock, George, Litten, <br />O'Leary, O'Malley, Rader. <br />A RESOLUTION to take effect immediately provided it receives the affirmative vote of <br />at least two thirds of the members of Council, or otherwise to take effect and be in force after the <br />earliest period allowed by law, approving of a street encroachment permit pursuant to Section <br />901.18 of the Codified Ordinances in favor of The Cleveland Clinic Foundation, in furtherance <br />of the approved site plan for the permittee's family health center. <br />WHEREAS, pursuant to the terms of the master agreement governing healthcare in <br />Lakewood dated December 21, 2015, The Cleveland Clinic Foundation is constructing a family <br />health center at the southwest corner of Belle and Detroit Avenues; and <br />WHEREAS, the master agreement required the City's Architectural Board of Review to <br />consider and ultimately approve of a site plan for the construction of the new family health <br />center; and <br />WHEREAS, the site plan approved by the Architectural Board of Review calls for a <br />drop -off and valet parking area and monument sign that are designed to occupy a portion of the <br />Belle Avenue public right -of -way located adjacent to the Clinic's property; and <br />WHEREAS, the Clinic is constructing sidewalks for public use along Belle Avenue as a <br />part of that approved site plan; and <br />WHEREAS, Section 901.18, Erecting Buildings or Structures on Public Ground, of the <br />Codified Ordinances of the City of Lakewood governs use of public grounds upon approval of <br />Council under the terms and conditions described in that Section; and <br />WHEREAS, as set forth in Section 2.12 of the Third Amended Charter of the City of <br />Lakewood, this Council by a vote of at least two thirds of its members determines that this <br />resolution is an emergency measure and that it shall take effect immediately, and that it is <br />necessary for the immediate preservation of the public property, health, and safety and to provide <br />for the usual daily operation of municipal departments in that the City wishes to ensure the <br />family health center opens on schedule in the second quarter of 2018; now, therefore, <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO <br />Section 1. The Council of the City of Lakewood hereby approves of a street <br />encroachment permit in the form attached hereto as Exhibit A, pursuant to Section 901.18 of the <br />Codified Ordinances, in favor of The Cleveland Clinic Foundation, in furtherance of the <br />approved site plan for the permittee's family health center, certain elements of which shall <br />occupy a portion of the Belle Avenue public right -of -way located adjacent to the permittee's <br />property at the southwest corner of Belle and Detroit Avenue. <br />
