Anderson, Bullock, George, Litten 0'Leary, <br />RESOLUTION NO. 2019-14 BY: <br />O'Malley, Rader <br />A RESOLUTION to take effect immediately provided it receives the affirmative vote of <br />at least two thirds of the members of Council, or otherwise to take effect and be in force after <br />the earliest period allowed by law, authorizing the Director of Finance to sell a 2008 Crimson <br />Fire Truck to the City of Cleveland, without the necessity of bidding in accordance with <br />Lakewood Codified Ordinance §111.04(a)(10) in accordance with the Agreement Between the <br />City of Lakewood and the City of Cleveland attached hereto as Exhibit A. <br />WHEREAS, the City of Lakewood listed the vehicle on GOV Deals and received a single <br />bid in the amount of $505000; and <br />WHEREAS, Lakewood also received an offer from a broker to either sell the vehicle for <br />Lakewood on a commission basis or to purchase it outright; and <br />WHEREAS, Cleveland needs a vehicle that has these capabilities and has obtained <br />authorization to purchase this fire truck for an amount not exceed $150,000; and <br />WHEREAS, it is in the best interest of the City to sell this vehicle without bidding in <br />order to obtain the best price; and <br />WHEREAS, as set forth in Section 2.12 of the Third Amended Charter of the City of <br />Lakewood, this Council by a vote of at least two thirds of its members determines that this <br />resolution is an emergency measure and that it shall take effect immediately, and that it is <br />necessary for the immediate preservation of the public property, health, and safety and to provide <br />for the usual daily operation of municipal departments, in order to make this vehicle available to <br />safety forces of the City of Cleveland immediately; now, therefore <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, OHIO: <br />Section 1. Council hereby determines that it is impractical to award the sale of a Crimson <br />Fire Truck under competitive bidding procedures, and that it is more cost-effective and in the <br />best interests of the City to award the contract without competitive bidding, and thus authorizes <br />the Director of Finance to award,a contract to the City of Cleveland for $150,000. <br />Section 2. Council specifically approves the agreement in substantially the same form as <br />that attached as Exhibit A. and as approved by the Director of Law. <br />Section 3. It is found and determined that all formal actions of this Council concerning <br />and relating to the passage of this resolution were adopted in an open meeting of this Council, <br />and that all such deliberation of the Council and of any of its committees that resulted in such <br />formal action were in meetings open to the public in compliance with all legal requirements. <br />
