Anderson, Bullock, George, Litten 0'Leary, RESOLUTION NO. 2019-14 BY: O'Malley, Rader A RESOLUTION to take effect immediately provided it receives the affirmative vote of at least two thirds of the members of Council, or otherwise to take effect and be in force after the earliest period allowed by law, authorizing the Director of Finance to sell a 2008 Crimson Fire Truck to the City of Cleveland, without the necessity of bidding in accordance with Lakewood Codified Ordinance §111.04(a)(10) in accordance with the Agreement Between the City of Lakewood and the City of Cleveland attached hereto as Exhibit A. WHEREAS, the City of Lakewood listed the vehicle on GOV Deals and received a single bid in the amount of $505000; and WHEREAS, Lakewood also received an offer from a broker to either sell the vehicle for Lakewood on a commission basis or to purchase it outright; and WHEREAS, Cleveland needs a vehicle that has these capabilities and has obtained authorization to purchase this fire truck for an amount not exceed $150,000; and WHEREAS, it is in the best interest of the City to sell this vehicle without bidding in order to obtain the best price; and WHEREAS, as set forth in Section 2.12 of the Third Amended Charter of the City of Lakewood, this Council by a vote of at least two thirds of its members determines that this resolution is an emergency measure and that it shall take effect immediately, and that it is necessary for the immediate preservation of the public property, health, and safety and to provide for the usual daily operation of municipal departments, in order to make this vehicle available to safety forces of the City of Cleveland immediately; now, therefore BE IT RESOLVED BY THE CITY OF LAKEWOOD, OHIO: Section 1. Council hereby determines that it is impractical to award the sale of a Crimson Fire Truck under competitive bidding procedures, and that it is more cost-effective and in the best interests of the City to award the contract without competitive bidding, and thus authorizes the Director of Finance to award,a contract to the City of Cleveland for $150,000. Section 2. Council specifically approves the agreement in substantially the same form as that attached as Exhibit A. and as approved by the Director of Law. Section 3. It is found and determined that all formal actions of this Council concerning and relating to the passage of this resolution were adopted in an open meeting of this Council, and that all such deliberation of the Council and of any of its committees that resulted in such formal action were in meetings open to the public in compliance with all legal requirements.
