Please substitute for the original <br /> Bullock, Litten, Neff, O'Malley, Rader, Shachner <br /> RESOLUTION NO. 2020-04 BY: <br /> A RESOLUTION to take effect immediately provided it receives the affirmative vote of <br /> at least two thirds of the members of Council, or otherwise to take effect and be in force after the <br /> earliest period allowed by law, ratifying and authorizing the Mayor of the City of Lakewood, <br /> Ohio, to enter into an Agreement with the Ohio Patrolmen's Benevolent Association <br /> (representing our Corrections Officers) of for a three-year period commencing January 1, 2020 <br /> and ending December 31, 2022. <br /> WHEREAS, the administration has conducted extensive negotiations with the Ohio <br /> Patrolmen's Benevolent Association (the "Union") as the bargaining representative for certain <br /> employees of the City; and <br /> WHEREAS, such negotiations have provided a tentative agreement between the parties <br /> for the years 2020-2022; and <br /> WHEREAS, Council and the administration have reviewed such proposal and do desire <br /> to ratify and adopt such agreement; and <br /> WHEREAS, as set forth in Section 2.12 of the Third Amended Charter of the City of <br /> Lakewood, this Council by a vote of at least two thirds of its members determines that this <br /> resolution is an emergency measure and that it shall take effect immediately, and that it is <br /> necessary for the immediate preservation of the public property,health, and safety and to provide <br /> for the usual daily operation of municipal departments, in that the current agreement is set to <br /> expire on December 31, 2019; now,therefore <br /> BE IT RESOLVED BY THE CITY OF LAKEWOOD, OHIO: <br /> Section 1. Council hereby ratifies and authorizes the Mayor to enter into an Agreement <br /> for a three-year period with the Union, on behalf of certain employees of the City, commencing <br /> January 1, 2020 and ending December 31, 2022; the form of the agreement is attached as Exhibit <br /> A and shall be on file in the office of the Director of Law. <br /> Section 2. It is found and determined that all formal actions of this Council concerning <br /> and relating to the passage of this resolution were passed in an open meeting of this Council and <br /> that all deliberations of this Council and any of its committees that resulted in such actions were <br /> in meetings open to the public and in compliance with legal requirements. <br /> Section 3. This resolution is hereby declared to be an emergency measure necessary for <br /> the immediate preservation of the public peace, property, health, safety and welfare in the City <br /> and for the usual daily operation of the City for the reasons set forth and defined in the preamble <br />
