ORDINANCE NO. 11-2020 <br />Placed on 1st reading & <br />referred to HPD 7/6/20 <br />Kepple., Lit.t_ena Neff ` <br />Of Mall Rader, <br />h <br />AN ORDINANCE to take effect immediately provided it receives the affirmative vote of <br />at least five members of Council, or otherwise to take effect and be in force after the earliest pe- <br />riod allowed by law, authorizing and directing the Director of Planning and Development or the <br />Mayor to enter into an agreement for the sale of Permanent Parcel No. 315-22-108 on Plover <br />Street. <br />WHEREAS, the City is the owner of the above listed vacant parcel and has negotiated the <br />sale of the parcel to an abutting property owner to be used as a side yard with improvements; and <br />WHEREAS, this Council has determined it is in the best interest of the City to sell said <br />real property and that such sale shall further the interest of the City and its residents; and <br />WHERAS, this Council by a vote of at least five of its members determines that this or- <br />dinance is an emergency measure, and that this ordinance shall take effect at the earliest date <br />possible as set forth in Article III, Sections 10 and 13 of the Second Amended Charter of the City <br />of Lakewood, and that it is necessary for the immediate preservation of the public property, <br />health and safety, and to provide for the usual daily operation of municipal department in that <br />these property is currently vacant and transfer should occur quickly; now, therefore, <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, OHIO: <br />Section 1. The Director of Planning and Development or the Mayor is hereby authorized. <br />to enter into an agreement for the sale of Permanent Parcel No. 315-22-108 on Plover Street with <br />Patty Levstick, the owner of the parcel abutting this property for $3,000. <br />Section 2. Either the Director, Mayor or the Director of Law is hereby authorized and di- <br />rected to enter into agreements and execute all ancillary and related instruments for the sale of <br />said real property. <br />Section 3. The Director shall make no representations or warranties concerning the condi- <br />tions of the property, including, but not limited to the property's environmental condition, me- <br />chanical systems, dry basements, foundations, structural integrity or compliance with code, zon- <br />ing or building requirements. <br />Section 4. It is found and determined that all formal actions of this Council concerning <br />and relating to the passage of this ordinance were adopted in an open meeting of this Council, <br />and that all such deliberations of this Council and of any of its committees that resulted in such <br />formal action were in meetings open to the public in compliance with all legal requirements. <br />
