Bullock, Kepple, Litten, Neff , O'Malley, Rader, Shachner RESOLUTION NO. 2020-65A BY: A RESOLUTION to take effect immediately provided it receives the affirmative vote of at least two thirds of the members of Council, or otherwise to take effect and be in force after the earliest period allowed by law, to amend Resolution 2020-65, adopted November 2, 2020 to correct the length of the term to be served by Council's appointee on the Tree Advisory & Education Board. V`TI EREAS, an expiring term will cause a vacancy on the Tree Advisory & Education Board beginning January 1, 2021 in a position occupied by a Council appointee, thus requiring appointment to the Board; and, WHEREAS, on November 2, 2020 Lakewood City Council adopted Resolution 2020-65 to make a one-year appointment to the Tree Advisory & Education Board; and, WHEREAS, Ordinance 23-19, adopted September 16, 2019 to establish the Tree Advisory & Education Board, stipulates that each member, after his or her initial appointment, shall serve a term of three -years in length; and, WB REAS, as set forth in Section 2.12 of the Third Amended Charter of the City of Lakewood, this Council by a vote of at least two thirds of its members determines that this resolution is an emergency measure and that it shall take effect immediately, and that it is necessary for the immediate preservation of the public property, health, and safety and to provide for the usual daily operation of municipal departments, in that this position should be filled immediately so as to ensure the Board is at full capacity to perform its work on January 1, 2021; now, therefore, BE IT RESOLVED BY THE CITY OF LAKEWOOD, OHIO: Section 1. That Resolution 2020-65, adopted November 2, 2020, currently reading as follows: Section 1. Council appoints Laura Balliett to the Tree Advisory & Education Board for a one-year term beginning January 1, 2021 and ending December 31, 2021. Section 2... . Is hereby amended to read as follows: Section 1. Council appoints Laura Balliett to the Tree Advisory & Education Board for a ene three-year term beginning January 1, 2021 and ending December 31, 2� 2023. Section 2... . Section 2. It is found and determined that all formal actions of this Council concerning and relating to the passage of this resolution were passed in open meetings of this Council and that all deliberations of this Council and any of its committees that resulted in such actions were in meetings open to the public and in compliance with legal requirements. Section 3. This resolution is hereby declared to be an emergency measure necessary for the immediate preservation of the public peace, property, health, safety and welfare in the City and for the usual daily operation of the City for the reasons set forth and defined in the preamble
