ORDINANCE NO. 09-2021 Bu11-oc:k, K(Ep le, Litton, Neff, O"Mall_ey, Rader,- Shac,,-liner AN ORDINANCE to take effect immediately provided it receives the vote of at least two thirds of the members of Council, or otherwise to take effect at the earliest period allowed by law, amending Section 1309.11 Occupancy Permits of the Lakewood Codified Ordinances to correct and include the inspection fee for Code Compliance Certificates within the City of Lakewood. WHEREAS, due to a potential conflict with Ohio law and confusion within the Lakewood Codified Ordinances, the Building Code was updated to distinguish between Code Compliance Certificates and Occupancy Permits; and WHEREAS, there was an oversight at that time and Code Compliance Certificates inspection was inadvertently not included in LCO Section 1309.11; and WHEREAS, this omission should be corrected; and WHEREAS, as set forth in Section 2.12 of the Third Amended Charter of the City of Lakewood, this Council by a vote of at least two thirds of its members determines that this ordinance is an emergency measure and that it shall take effect immediately, and that it is necessary for the immediate preservation of the public property, health, and safety and to provide for the usual daily operation of municipal departments, in that clarification is necessary to collect the appropriate inspection fees for Code Compliance Certificate inspections; now, therefore BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD: Section 1. That Section 1309.11, Occupancy Permits, of the Lakewood Codified Ordinances, currently reading as follows: 1309.11 OCCUPANCY PERMITS. For any inspections made for the issuance of a Certificate of Occupancy, there shall be charged a fee of fifty dollars ($50.00) for residential and seventy-five dollars ($75.00) for commercial. is hereby repealed. Section 2. That new Section 1309.11 Ocupancy Permits and Code Compliance Certificates, of the Lakewood Codified Ordinances is hereby enacted to read as follows: 1309.11 OCCUPANCY PERMITS AND CODE COMPLIANCE CERTIFICATES. For any inspections made for the issuance of a Certificate of Occupancy or a Code Compliance Certificate, there shall be charged a fee of fifty dollars ($50.00) for residential and seventy-five dollars ($75.00) for commercial.
