Placed on 1st reading & <br />referred to Public Safety <br />5/17/21; 2nd reading 6/7/21 <br />Bullock, Kepple, Litten, Neff, <br />ORDINANCE NO. 18-2021 By: O'Malley, Rader, S ha chase r �! <br />i <br />......................... <br />AN ORDINANCE to take effect immediately provided it receives the affirmative vote of <br />at least two thirds of the members of Council, or otherwise to take effect and be in force at the <br />earliest period allowed by law, amending Section 549.02, Carrying Concealed Weapons and <br />Section 549.07 Unlawful Transactions in Weapons, of the Codified Ordinances of the City of <br />Lakewood. <br />WHEREAS, SB 140, effective April 12, 2021 was enacted that made changes to the Ohio <br />Revised Code Sections governing carrying concealed weapons and unlawful transactions in <br />weapons; and <br />WHEREAS, BB 228, effective March 2019, took all municipal home rule authority away <br />from municipalities governing weapons -related licensing, permissions, restrictions, delays, or <br />processes; and <br />WHEREAS, therefore, municipal codes must mirror the Ohio Revised Code as to these <br />areas; and <br />WHEREAS, carrying concealed weapons and unlawful transactions in weapons <br />restrictions within the City of Lakewood must be amended to mirror the Ohio Revised Code <br />versions of these same offenses; and <br />WHEREAS, as set forth in Section 2.12 of the Third Amended Charter of the City of <br />Lakewood, this Council by a vote of at least two thirds of its members determines that this <br />ordinance is an emergency measure and that it shall take effect immediately, and that it is necessary <br />for the immediate preservation of the public property, health, and safety and to provide for the <br />usual daily operation of municipal departments, in that the reduction of false fire alarm calls should <br />be pursued immediately in order to remain consistent with the weapons provisions contained in <br />the Ohio Revised Code; now, therefore <br />Section 1. That Section 549.02, Carrying Concealed Weapons, of the Lakewood Codified <br />Ordinances is currently reading as follows: <br />549.02 CARRYING CONCEALED WEAPONS. <br />(a) No person shall knowingly carry or have, concealed on the person's person or concealed ready <br />at hand, any of the following: <br />(1) A deadly weapon other than a handgun; <br />(2) A handgun other than a dangerous ordnance; <br />(3) A dangerous ordnance. <br />(b) No person who has been issued a concealed handgun license shall do any of the following: <br />(1) If the person is stopped for a law enforcement purpose and is carrying a concealed handgun, <br />fail to promptly inform any law enforcement officer who approaches the person after the person has <br />
