ORDINANCE NO.20-2021 <br />Placed on 1st reading <br />& referred to HPD <br />6/7/21; 2nd reading <br />6/21/21 <br />Bullock, Kepple, L.i.tten, Neff, <br />BY: O'Malley, Rader, Shachner <br />AN ORDINANCE to take effect immediately provided it receives the affirmative vote of <br />at least two thirds of the members of Council, or otherwise to take effect and be in force after the <br />earliest period allowed by law, authorizing and directing the Director of Planning and Develop- <br />ment or the Mayor to enter into an agreement with a licensed real estate broker to market for sale <br />the real property located at 12311 Plover Street, Lakewood, Ohio (PPN 315-22-089) and 17450 <br />Shaw Avenue, Lakewood, Ohio (PPN 311-21-062045) for a period of 180 days, pursuant to Sec- <br />tion 155.07 of the Codified Ordinances. <br />WHEREAS, the City is the owner of the above -listed property; and <br />WHEREAS, the single-family residential homes have been renovated and will be made <br />available as eligible income households to expand homeownership opportunities for low -and <br />moderate -income owners; and <br />WHEREAS, this Council has determined it is in the best interest of the City to sell said <br />real property and that such sale shall further the interest of the City and its residents; and <br />WHEREAS, as set forth in Section 2.12 of the Third Amended Charter of the City of <br />Lakewood, this Council by a vote of of least two thirds of its members determines that this ordi- <br />nance is an emergency measure and that it shall take effect immediately, and that it is necessary <br />for the immediate preservation of the public property, health, and safety and to provide for the <br />usual daily operation of municipal departments, in that these properties should be marketed for <br />sale as soon as is reasonably possible to encourage owner occupancy of the properties; now, <br />therefore, <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, OHIO: <br />Section 1. The Director of Planning and Development ("Director") or Mayor is hereby <br />authorized and directed, on behalf of the City, to solicit proposals from licensed real estate bro- <br />kers and to enter into an agreement with the broker deemed most responsive determined by the <br />Director, to market real property located at 12311 Plover Street, Lakewood, Ohio (PPN 315-22- <br />089) and 17450 Shaw Avenue, Lakewood, Ohio (PPN 311-21-062045) for a period of 180 <br />days, pursuant to Section 155.07 of the Codified Ordinances. <br />Section 2. Either the Director, Mayor, the Director of Law or their designee is hereby au- <br />thorized and directed to enter into agreements and execute all ancillary and related instruments <br />for the sale of said real property upon presentation of an acceptable offer as determined by the <br />Director. <br />
