Referred to Finance 6/21/21 <br />Bt. l©ck, Kepple, Litten, Neff, O'Malley, Rader <br />L 2 RESOLUTION N0.20 1-33 BY. <br />A RESOLUTION to take effect immediately provided it receives the affirmative vote of at <br />least two thirds of the members of Council, or otherwise to take effect and be in force after the <br />earliest period allowed by law, authorizing the Mayor and/or Director of Finance or Director of <br />Law to allocate Twenty -Five Million Dollars ($25,000,000) to effectuate the modernization and <br />construction of the City of Lakewood's sewer system with such funds allocated from the American <br />Rescue Plan ("ARP") and Coronavirus State and Local Fiscal Recovery Funds ("CSLFRF"); <br />WHEREAS, Lakewood shall be receiving $47,219,575 of CSLFRF through the ARP, with <br />the first fifty percent (50%) received this year and the second fifty percent (50%) to be received <br />next year, and; <br />WHEREAS, Lakewood is commencing on an approximately $300,000,000 to the Sewer <br />Improvement Project (defined below) for sewer modernization and upgrade plan to its century -old <br />infrastructure in conformity with federal and state regulation, and; <br />WHEREAS, based upon the eligibility parameters and guidance provided by US <br />Department of Treasury, direct investment in municipal sewer infrastructure projects are deemed <br />eligible expenditures; and <br />WHEREAS, as set forth in Section 2.12 of the Third Amended Charter of the city of <br />Lakewood, this Council by a vote of at least two thirds of its members determines that this <br />resolution is an emergency measure and that it shall take effect immediately, and that it is necessary <br />for the immediate preservation of the public peace, property, health and safety, and to provide for <br />the usual daily operation of municipal departments in order to receive and make these funds <br />available as soon as possible; now, therefore. <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, OHIO: <br />Section 1. That Twenty -Five Million Dollars ($25,000,000.00) be allocated to the <br />modernization and construction of the City of Lakewood's sewer system (the"Sewer Improvement <br />Project") with such funds allocated from the American Rescue Plan ("ARP") and Coronavirus <br />State and Local Fiscal Recovery Funds ("CSLFRF") received by the City of Lakewood after <br />distribution from the US Department of Treasury. <br />Section 2. The Mayor, Director of Law, and/or Director of Finance are empowered, <br />authorized and directed to enter into any and all agreements necessary to effectuate the Sewer <br />Improvement Project. <br />Section 3. It is found and determined that all formal actions of this Council concerning and <br />relating to the passage of this resolution were adopted in an open meeting of this Council, and that <br />all such deliberations of this Council and any of its committees that resulted in such formal action, <br />were in meetings open to the public, in compliance with all legal requirements. <br />
