Referred to PWS 12/20/21; <br />Recommended for adoption by <br />PWS 1/18/22 <br />Baker, Bullock, Kepple, Litten, <br />RESOLUTION NO.2021-61 BY: Of Malley, Rader, Shachner <br />A RESOLUTION to take effect immediately provided it receives the affirmative <br />vote of at least two thirds of the members of Council, or otherwise to take effect and be in <br />force after the earliest period allowed by law, authorizing the Mayor or her designee to <br />enter into an agreement to accept a grant in the amount of $3,280,000 from the Ohio De- <br />partment of Development for the City's 2022 Watermain Replacement Project. <br />WHEREAS, the Ohio Department of Development has notified the City of Lake- <br />wood of an award of $3,280,000 in Ohio Water and Wastewater Infrastructure Grand <br />Program funds which will offset the 2022 Andrews and Gladys Watermain Replacement <br />Project; and <br />WHEREAS, no matching funds are required for this grant; and <br />WHEREAS, as set forth in Section 2.12 of the Third Amended Charter of the City <br />of Lakewood, this Council by a vote of at least two thirds of its members determines that <br />this resolution is an emergency measure and that it shall take effect immediately, and that <br />it is necessary for the immediate preservation of the public property, health, and safety <br />and to provide for the usual daily operation of municipal departments in that Lakewood <br />must enter into this agreement in order of access these funds for the 2022 project year; <br />now, therefore, <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, OHIO: <br />Section 1. The Mayor or her designee is hereby authorized enter into an agree- <br />ment to accept a grant in the amount of $3,280,000 from the Ohio Department of Devel- <br />opment for the City's 2022 Watermain Replacement Project. <br />Section 2. That Mark Papke, City Engineer, is hereby designated Project Manag- <br />er and is directed to execute a grant agreement and any other documents required with the <br />Ohio Department of Development for the acceptance of the grant dollars. <br />Section 3. That the City of Lakewood does agree to obligate funds required to <br />satisfactorily complete the proposed project and become eligible for reimbursement under <br />the terms and conditions of the Coastal Management Assistance Grants Program. <br />Section 2. It is found and determined that all formal actions of this Council con- <br />cerning and relating to the passage of this resolution were adopted in an open meeting of <br />this Council, and that all such deliberations of this Council and of any of its committees <br />that resulted in such formal action were in meetings open to the public, in compliance <br />with all legal requirements. <br />Section 3. This resolution is hereby declared to be an emergency measure neces- <br />sary for the immediate preservation of the public peace, property, health, safety and wel- <br />fare in the City and for the usual daily operation of the City for the reasons set forth and <br />
