Referred to PWS 12/20/21; Recommended for adoption by PWS 1/18/22 Baker, Bullock, Kepple, Litten, RESOLUTION NO.2021-61 BY: Of Malley, Rader, Shachner A RESOLUTION to take effect immediately provided it receives the affirmative vote of at least two thirds of the members of Council, or otherwise to take effect and be in force after the earliest period allowed by law, authorizing the Mayor or her designee to enter into an agreement to accept a grant in the amount of $3,280,000 from the Ohio De- partment of Development for the City's 2022 Watermain Replacement Project. WHEREAS, the Ohio Department of Development has notified the City of Lake- wood of an award of $3,280,000 in Ohio Water and Wastewater Infrastructure Grand Program funds which will offset the 2022 Andrews and Gladys Watermain Replacement Project; and WHEREAS, no matching funds are required for this grant; and WHEREAS, as set forth in Section 2.12 of the Third Amended Charter of the City of Lakewood, this Council by a vote of at least two thirds of its members determines that this resolution is an emergency measure and that it shall take effect immediately, and that it is necessary for the immediate preservation of the public property, health, and safety and to provide for the usual daily operation of municipal departments in that Lakewood must enter into this agreement in order of access these funds for the 2022 project year; now, therefore, BE IT RESOLVED BY THE CITY OF LAKEWOOD, OHIO: Section 1. The Mayor or her designee is hereby authorized enter into an agree- ment to accept a grant in the amount of $3,280,000 from the Ohio Department of Devel- opment for the City's 2022 Watermain Replacement Project. Section 2. That Mark Papke, City Engineer, is hereby designated Project Manag- er and is directed to execute a grant agreement and any other documents required with the Ohio Department of Development for the acceptance of the grant dollars. Section 3. That the City of Lakewood does agree to obligate funds required to satisfactorily complete the proposed project and become eligible for reimbursement under the terms and conditions of the Coastal Management Assistance Grants Program. Section 2. It is found and determined that all formal actions of this Council con- cerning and relating to the passage of this resolution were adopted in an open meeting of this Council, and that all such deliberations of this Council and of any of its committees that resulted in such formal action were in meetings open to the public, in compliance with all legal requirements. Section 3. This resolution is hereby declared to be an emergency measure neces- sary for the immediate preservation of the public peace, property, health, safety and wel- fare in the City and for the usual daily operation of the City for the reasons set forth and
