Placed on 1st reading & referred to Public <br />Safety 3/21/22. 2nd reading 4/4/22 <br />Baker, Bullock, Kepple, Litten, <br />ORDINANCE NO. 15-2022 Rader, S ha cline r <br />AN ORDINANCE to take effect immediately provided it receives the affirmative vote of <br />at least five (5) members of Council, or otherwise to take effect and be in force after the earliest <br />period allowed by law, amending Section 335.01, Driver's or Commercial Driver's License <br />Required, of the Codified Ordinances of the City of Lakewood in order update the penalties for <br />violation of this provision to match those established in the Ohio Revised Code. <br />WI -AREAS, it is desired that the penalty for driving without an operator's license in the <br />City of Lakewood be the same as established under State Law; and <br />WHEREAS, amending this section of the Lakewood Codified Ordinance will eliminate <br />any confusion as to the penalty for violation of this section; and <br />WHEREAS, as set forth in Section 2.12 of the Third Amended Charter of the City of <br />Lakewood, this Council by a vote of at least two thirds of its members determines that this <br />ordinance is an emergency measure and that it shall take effect immediately and that it is <br />necessary for the immediate preservation of the public property, health, and safety and to provide <br />for the usual daily operation of municipal departments in that Lakewood's penalty should be the <br />same as established in the Ohio Revised Code; now, therefore <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br />Section 1. That Section 335.01, Driver's or Commercial Driver's License Required, <br />of the Codified Ordinances of the City of Lakewood, currently reading as follows: <br />335.01 DRIVER'S OR COMMERCIAL DRIVER'S LICENSE REQUIRED. <br />(a) (1) No person, except those expressly exempted under Ohio R.C. 4507.03, 4507.04, and <br />4507.05, shall operate any motor vehicle upon a public road or highway or any public or private <br />property used by the public for purposes of vehicular travel or parking in this Municipality unless <br />the person has a valid driver's license issued under Ohio R.C. Chapter 4507 or a commercial <br />driver's license issued under Ohio R.C. Chapter 4506. <br />(2)- No person, except a person expressly exempted under Ohio R.C. 4507.03, 4507.04, and <br />4507.05, shall operate any motorcycle upon a public road or highway or any public or private <br />property used by the public for purposes of vehicular travel or parking in this Municipality unless <br />the person has a valid license as a motorcycle operator that was issued upon application by the <br />Registrar of Motor Vehicles under Ohio R.C. Chapter 4507. The license shall be in the form of an <br />endorsement, as determined by the Registrar, upon a driver's or commercial driver's license, if the <br />person has a valid license to operate a motor vehicle or commercial motor vehicle, or in the form <br />of a restricted license as provided in Ohio R.C. 4507.14, if the person does not have a valid license <br />to operate a motor vehicle or commercial motor vehicle. <br />
