Placed on 1st reading & <br />referred to Finance 06/21/22; <br />2nd reading 07/05/22 <br />Baker, Bullock, Litten, Marx, <br />ORDINANCE NO. 22-2022 S ha cline r <br />AN ORDINANCE to take effect immediately provided it receives the affirmative vote of <br />at least five (5) members of Council, or otherwise to take effect and be in force after the earliest <br />period allowed by law, creating a D.A.R.E. (Drug Awareness Resistance Education) special <br />revenue fund for internal financial controls pursuant to Ohio Revised Code §2981.13(D). <br />WHEREAS, O.R.C. §2981.13(D) requires that at least ten percent of the first one <br />hundred thousand dollars of amounts deposited during any calendar year in the agency's law <br />enforcement trust fund under this section, and at least twenty percent of the amounts exceeding <br />one hundred thousand dollars that are so deposited, shall be used in connection with community <br />preventive education program." <br />WI -AREAS, O.R.C. §2981.13(D) also states community preventative education <br />programs include but are not limited to, DARE programs and other programs designed to <br />educate adults and children with respect to the dangers associated with using drugs of abuse; and <br />WHEREAS, the City of Lakewood's Division of Police presently provide a city-wide <br />DARE program in the Lakewood City Schools; and <br />WHEREAS, creating this fund will allow for financial controls of these funds; and <br />WHEREAS, as set forth in Section 2.12 of the Third Amended Charter of the City of <br />Lakewood, this Council by a vote of at least two thirds of its members determines that this <br />ordinance is an emergency measure and that it shall -take effect immediately and that it is <br />necessary for the immediate preservation of the public property, health, and safety and to provide <br />for the usual daily operation of municipal departments in that this fund is needed for. financial <br />control purposes; now, therefore, <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO <br />Section 1. That new Section 129.321 DARE Special Revenue Fund of the Lakewood <br />Codified Ordinances, is hereby created to read as follows: <br />Section 129.321 DARE Special Revenue Fund. <br />Ten percent of all annual revenues deposited in the Law Enforcement Trust Fund and Drug <br />Enforcement Trust fund shall be kept and maintained in a separate fund hereby designated the <br />DARE Special Revenue Fund. All expenditures for the city-wide DARE program and any other <br />eligible expenses shall be paid from this fund. <br />Section 2. It is found and determined that all formal actions of this Council concerning and <br />relating to the passage of this ordinance were adopted in an open meeting of this Council, and <br />that all such deliberation of the Council and of any of its committees that resulted in such formal <br />action were in meetings open to the public in compliance with all legal requirements. <br />
