y Baker, Bullock, Kepple, Marx, <br />ORDINANCE NO. 27-2022 BY: Rader, Shachner <br />AN ORDINANCE to take effect immediately provided it receives the affirmative vote of <br />at least two thirds of the members of Council, or otherwise to take effect and be in force at the <br />earliest period allowed by law, creating the "Opioid Settlement Fund" for receipt of funds for the <br />OneOhio Opioid Distributor Settlement for eligible expenses pursuant to the OneOhio <br />memorandum of understanding related to Ohio Abatement Strategies including Community <br />Recovery, Statewide Innovation & Recovery, and Sustainability. <br />WHEREAS, the City of Lakewood is eligible to receive annual payments from the <br />OneOhio Distributor Settlement with McKesson, Cardinal and AmerisourceBergen; and <br />WHEREAS, the settlement resources will be used for eligible expenses that address <br />healthcare needs stemming from the opioid crisis, in accordance with the OneOhio memorandum <br />of understanding related to OneOhio Abatement Strategies including Community Recovery, <br />Statewide Innovation & Recovery, and Sustainability and Auditor of State Bulletin No. 2022-003; <br />and <br />WHEREAS, the city requires a fund to accept the Opioid Distributor Settlement Resources; <br />and <br />WHEREAS, as set forth in Section 2.12 of the Third Amended Charter of the City of <br />Lakewood, this Council by a vote of at least two thirds of its members determines that this <br />ordinance is an emergency measure and that it shall take effect immediately, and that it is necessary <br />for the immediate preservation of the public property, health, and safety and to provide for the <br />usual daily operation of municipal departments to provide for the usual daily operation of the City <br />in that the City must create this fund before benefiting from the proceeds of the settlement. Now <br />therefore, <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, OHIO <br />Section 1. That the new "Opioid Settlement Fund" is hereby established for the receipt <br />of funds from the OneOhio Distributor Settlement, and any other related sources, for eligible <br />expenses as prescribed by the OneOhio memorandum of understanding including community <br />recovery, statewide innovation & recovery, sustainability, Auditor of State Bulletin 2022-03, and <br />any other permitted uses. <br />Section 2. It is found and determined that all formal actions of this Council concerning and <br />relating to the passage of this ordinance were adopted in an open meeting of this Council, and that <br />all such deliberations of this Council and of any of its committees that resulted in such formal <br />action were in meetings open to the public in compliance with all legal requirements. <br />Section 3.
