Baker, Bullock, Kepple, Marx, Rader <br />S. ORDINANCE NO. 30-2022 BY: <br />AN ORDINANCE to take effect immediately provided it receives the affirmative vote of at <br />least two thirds of the members of Council enacting Section 1306.76 Backflow Prevention and Cross - <br />Contamination Control to provide an effective means for protecting the public water system from <br />contamination due to backflow of contaminants through the water service connection into the public <br />water system. <br />WHEREAS, Section 6109.13 of the Ohio Revised Code (O.R.C.) requires protection of the <br />public water system from contamination through any connection whereby water from a private, <br />auxiliary or emergency water system may enter the public water system; and <br />WHEREAS, Section 3745-95 of the Ohio Administrative Code (O.A.C.) requires protection <br />of the public water system from contamination due to backflow of contaminants through the water <br />service connection; and <br />WHEREAS, the Ohio Environmental Protection Agency requires the maintenance of a <br />continuing program of backflow prevention and cross -connection control which will <br />systematically and effectively prevent the contamination of all potable water systems; and <br />WHEREAS, while Lakewood has had necessary regulations in place to comply with O.R.C. <br />and O.A.C. requirements, codifying these requirements and updating the regulations is necessary <br />to ensure compliance and enforcement; and <br />WHEREAS, as set forth in Section 2.12 of the Third Amended Charter of the City of <br />Lakewood, this Council by a vote of at least two thirds of its members determines that this <br />ordinance is an emergency measure and that it shall take effect immediately and that it is necessary <br />for the immediate preservation of the public property, health, and safety and to provide for the <br />usual daily operation of municipal departments in that regulations for backflow prevention should <br />go into effect for immediate compliance and enforcement; now, therefore <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, OHIO: <br />Section 1. That new Section 1306.76 Backflow Prevention and Cross -Connection Control <br />of the Lakewood Codified Ordinances is hereby enacted to read as follows: <br />1306.76 Backflow Prevention and Cross -Connection Control <br />(a) The Building Commissioner or designee, is hereby authorized to establish rules and <br />regulations preventing back flows into the public water supply and controls to prevent cross - <br />contamination of the public water supply. An approved backflow prevention assembly is necessary for <br />the safety of the public water system, the Building Commissioner or designee will give notice to the <br />water consumer to install such an approved assembly immediately. The water consumer shall, at his <br />own expense, install such an approved assembly at a location in a manner approved by the Building <br />Commissioner or designee and shall have inspections and tests made of such approved assemblies as <br />required by the Building Commissioner or designee. <br />
