MINUTES OF COMMITTEE OF THE WHOLE <br /> October 10, 2022 <br /> AUDITORIUM <br /> Present: Councilmembers Litten, Kepple, Baker, Marx, Bullock, Rader& Shachner <br /> Also Present: Mayor George, Law Director Ernie Vargo, Director Shawn Leininger, Clerk Bach <br /> and Council staff taking minutes <br /> Call to Order: 6:03 p.m. <br /> Motion by President Litten, seconded by Vice President Kepple to approve the minutes of the <br /> September 26, 2022 Committee of the Whole. All in favor. Motion passed. <br /> Director Leininger reported on the progress of the downtown development since the committee's <br /> last update. On October 6 1 Planning Commission reviewed a MOU between the City and the <br /> contractor hired to perform the traffic study of the area. The MOU clarified the scope of the <br /> study. Director Leininger explained that the current focus is on preparing for the anticipated <br /> October 241h Joint Meeting with the Board of Education. Following that meeting, there will be an <br /> ABR meeting October 26th. He shared slides that have been prepared for that meeting and <br /> directed the committee to the slides pertaining to the community space and the space between the <br /> garage and Building 42. He reported that ABR is requesting the addition atop the Curtis Block be <br /> setback an additional 8 feet to match the setback of Roundstone. He expects approvals to be <br /> before Council at the end of January 2023. <br /> RESOLUTION 2022-40 - A RESOLUTION to take effect immediately provided it <br /> receives the affirmative vote of at least two thirds of the members of Council, or otherwise <br /> to take effect and be in force after the earliest period allowed by law, approving the <br /> appointment of Ernie Vargo to the position of Director of Law upon his or her taking the <br /> oath of office. (Referred to COW 10/03/22) <br /> President Litten welcomed Law Director Ernie Vargo to the meeting. <br /> Law Director Vargo introduced himself to the council and expressed his appreciation for Mayor <br /> George's nomination of him for the position of law director. He expressed his willingness to <br /> answer any questions the Council had for him. <br /> Councilmember Rader congratulated Mr. Vargo for being appointed to the position of law <br /> director. He then asked about Mr. Vargo's background and how it may apply to a municipal <br /> setting. <br /> Law Director Vargo spoke about his previous 37 years of practice. He expressed his trust for <br /> law, advising, and litigation. He has not done municipal law in the past, but he described his <br /> ability to learn, listen, and collaborate to benefit the client, which in this case, would be the city. <br /> 1 <br />
