MINUTES OF THE HOUSING, PLANNING & DEVELOPMENT COMMITTEE <br /> November 14, 2022 <br /> Auditorium <br /> Present: Councilmembers Bullock, Shachner & Kepple <br /> Also Present: Councilmembers Marx & Rader, Law Director Vargo, Planning Director <br /> Leininger, Assistant Planning Director Milius, Clerk Bach taking minutes and Council staff <br /> Call to order: 7:05 p.m. <br /> Approval of the minutes of the September 26, 2022 Housing, Planning & <br /> Development Committee meeting. <br /> Motion made and seconded to approve the minutes of the September 26h meeting of the <br /> Housing, Planning & Development Committee. All members voted in favor. Motion passed. <br /> ORDINANCE 33-2022 -AN ORDINANCE to take effect immediately provided it <br /> receives the affirmative vote of at least five(5) members of Council, or otherwise to <br /> take effect and be in force after the earliest period allowed by law, amending <br /> Section 1161.03(t), Outdoor Dining, of the Codified Ordinances of the City of <br /> Lakewood. (1st read& referred to PC& HPD 10/3/22; 2"d reading 10/17/22) <br /> Councilmember Bullock introduced Ord. 33-2022 and Ord. 34-2022, explaining that both were <br /> simultaneously referred to Housing, Planning & Development Committee and the Planning <br /> Commission. Recently, the Planning Commission referred both ordinances back to Council, <br /> along with some additional changes to Ord. 33-2022. <br /> Councilmember Shachner expressed support for the proposed changes, which he characterized as <br /> flexible and creative. He noted that that the changes empower the Planning Commission in an <br /> appropriate way. <br /> Director Leininger referred to the new draft version of Ord. 33-2022 that incorporates changes <br /> by the administration and Planning Commission and requested that the committee consider <br /> adoption of that version tonight. <br /> Assistant Director Milius explained that the proposed changes to outdoor dining were based <br /> upon the success of expanded outdoor dining during COVID. The city experienced mainly <br /> positive outcomes from the expansion and is hoping to maintain the positive experience for <br /> restaurants and customers by making permanent the temporary changes. She explained how <br /> restaurants were engaged and offered input during the revision process. She explained the <br /> following changes that would go into effect, should the legislation be adopted: <br /> • Lower insurance requirement for sidewalk dining <br /> • Remove absolute seating limits <br /> • Remove absolute barrier requirements <br /> • Allow flexibility in the use of the sidewalk <br /> 1 <br />
