ORDINANCE NO. 55-80 BY: <br /> <br />Graham, McBride, Salmon, <br />Wendling, Brown, Chinnock, <br />Gal 1 agher <br /> <br /> AN EMERGENCY ORDINANCE to amend Section 541.07 of the General <br />Offenses Code of the Codified Ordinances of the City of Lakewood so as to <br />include damage to the nationality trees situated in Lakewood Park. <br /> WHEREAS, on April 25, 1980 the City dedicated the seven'nationality <br />trees planted in Lakewood Park, and <br /> <br /> WHEREAS, it is the intention of the City to continue to plant up <br />to twenty or more trees to represent and commerate the nationalities represented <br />by the citizens of the City of Lakewood, and' <br /> <br /> WHEREAS, it is the opinion of this Council that additional protection <br />will be offered to these symbolic ~rees by providing for a more severe penalty <br />than is provided for the destruction of regular trees under Section 541.06 of <br />the Codified Ordinances of the City of Lakewood, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure providing <br /> for the inrnediate preservation of the public safety and welfare and for the <br /> usual daily operation of a municipal department; now, therefore, o. <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF <br /> OHIO: <br /> <br /> Section 1. That Section 541.07 of the General Offenses Code of the <br /> Codified Ordinances of the City of Lakewood now reading as follows: <br /> <br />541.07 DESECRATION. <br /> <br />(a) No person, without privilege to do so, shall purposely <br /> deface, damage, pollute or otherwise physically mistreat <br /> any of the following: <br /> <br /> (1) The flag of the United States or of this State; <br /> (2) 'Any public monument; <br /> (3) Any historical or commenorative marker, or any <br /> <br />(b) <br /> <br /> structure, Indian mound or earthwork, thing or <br /> site of great historical or archaeological interest; <br />(4) A place of worship or its furnishings; <br />(5) A work of art or museum piece; <br />(6) Any other object of reverence or sacred devotion; <br /> <br />Whoever violates this section is guilty of desecration, a <br />misdemeanor of the second degree. <br /> <br />be and the same is hereby amended to read as follows: <br /> <br />541.07 DESECRATION. <br /> <br />(a) <br /> <br />No person, without privilege to do so, shall purposely <br />deface, dama§e,-pollute o,r oth.erwise.phy$ically mistreat <br />any of the following: <br /> <br />(1) The flag of the United, States or of this State; <br />(2) Any public monument; ~. <br />(3) Any histocial or commenorative marker, or any <br /> structure, Indian mound or earthwork, thing or <br /> site of great.historical or archaeological interest; <br />(4) A place of worship or its furnishings; <br />(5) A work of art or museum piece; <br />(6) Any other object of reverence or sacred devotion; <br />(7) The trees situated in Lakewood Park designated and <br /> identified or marked as nationality trees. <br /> <br />(b) Whoever violates this section is guilty of desecration, a <br /> misdemeanor of the second degree. <br /> <br /> <br />
