SLBDNISI ON &.IMNWOOD GARDENS NOo.2 . <br />4S A HARIJSKCP GASE. _ <br />NTiERTAS, it appears that the owner of proposed Gabriel Subdivision of <br />Kenwood Gardens No. 2 and its predecessor in title have submitted Preliminar-j <br />plans to the Planning & Zoninv Commission and the Council of tne Village of <br />T'Zayfield, Ohio, prior to the clate of-the adoption of ardinance Noo. 566, <br />which requires concrete roads; and <br />1r?REAS, it appears that the owners of said proposed subdivision <br />have spent a large amount of money for engineerin.g, 7.ega1 and other expense <br />in c onnection with the development of said proposed subdivision, under the <br />ass umption and belief that it Trrould be perinis sible to install asphalt <br />roads under the specificat:ions prov:ided in the orclUna.izce in force prior <br />to the adoption of 4rdinance No. 566; and <br />1MREAS, the owner of said proposed subdivision is wi1.1.ing to <br />install vri.der roads t-han requ-ired by said previous ordinan.ce and is wi.llLllg <br />to install a certain type of curb hereinafter described whiciz was not <br />required by the former ordinance and is a1so willing to go to considerable <br />expense to ins-tall a pumping station, which wi71 make it possible to pump <br />' sewage into the Wilson I`'Ii]1s Road Sanitax^,,r Sewer, this being Far superior <br />to the use of septic tanks; and <br />'"tMREAS, the Planning and Zona.ng Comtnission of the Village of j'Tayfield <br />' has approved the granting of an exception to the requisements of Section 6 <br />of ardinance No. 468, as amended by ardiriance Noa 566, as a harclshiip case3 <br />by permitting the instal,l.ation of asphalt roads. <br />NUA7 THEREFORE BE IT RESOL?D BY TFiE COUNCIL CF THE VILL4GE OF 110FIELD, <br />C iJYAHOCTA COUIVTY OHTO, . THA.T: <br />Sec, 1. Council finds, for t're reasons here:ixabove stated, tha-t it <br />would work a hards}.iip upon the owner of proposed Gabrzel Subdivision of <br />Kenwood Gardens No. 2 to requi.re it to install concreie roads in accordance <br />with Section 6 of Qrdinance No. 468 as amended by ardinance I+loe 566. Cou.n.cil <br />therefore, as an exception to the provisions of said 0rdinance No. 566, <br />de-tei°mines that it wi71 approve pl.a.ns, i.f in all other respects they are <br />proper, for the paving of the roads and streets in said proposed Gabriel <br />Subdivision of Kenwood Gardens Noa 2 wi.th plant-7nix asphalt, such asphalt
