The Vi71a ge as sumes the resp ons ibility of perf orrning the <br />maintenance of all grac3e separated Village streets, including the routi.ne <br />maintenance of the irearing surfaces on structures tdlat carry said Vi]lage <br />streets over the freeway., it being unclerstood tYLat the St,ate will mainta3.n the <br />actual bridge structures located within the ImprovFanent_right-of-sTay as well <br />as all cut and fi]1 slopes and other Village,street roadway -tems that are <br />rendered i.naccessible from said Village street by fencing or o-ther physical <br />barriers constructed as a part of the Improvement. <br />Seco 6, The Village cansents to the rearrangement' wi.thaut cost to <br />the Village, of sanitary sewers' water mains, serv3.ce lines, fire hydrants., <br />vaZve boxes and appurtenances thereto, or other municipalized utilities., <br />lying inside the corporate limits of the Vi]?age made necessary by the <br />construct,ion of the Tmprovement, and said_ Vi]J.age,, prior to the award of a <br />contract by the State, fv.rther agrees -Eha-t the State may 'make arrangements <br />wi.th or obtain agreement,s from any ancl a31 publiclv, pr3.vately anc3 caoperatively <br />ow-ned u-ts7.ity companies to relocate or rearrange their 13nes' of arry natv.re <br />wha-tsoever, wliich will be affecfi,sd by or interfere with the construction of the <br />ImprovemenL without cost to the Village, saia lines existing in their present <br />location by virtue of franchise or ot,her agreements legally in effecte <br />Sec. 7. 'Phe Mayor is Piereby authorized and directed an behalf of the <br />ViLl.age to_enter into such agreements as are necessaxy to carry foxnaard the <br />intent and purp os e of this Re5 olution, <br />Sec. 8. `Phe Clerk of the legislative authority is hereby di.rected <br />to furnish tate with a cerf,ified copy of this Resolution inm!edia?tely <br />upon its ente?actanent; and' upon the acceptance and approval of saa.d Resolution <br />by the State' it shall become a binding agreement between the Village and the <br />State.
