Carmen <br />AN ORDINANCE AMENDING SECTION <br />739.06(b) OF THE CODIFIED ORDI- <br />NANCES OF MAYF IELD V ILLAGE, OH I0, <br />PERTAINING TO APPLICABLE RULES AND <br />REGULATIONS FOR CANVASSERS AND <br />SOLICITORS WITHIN THE MUNICIPALITY. <br />WHEREAS, the Council of Mayfield Village, Ohio, enacted <br />Ordinance No. 78-34 on August 29, 1978, said Ordinance enacting <br />Chapter 739 of the Codified Ordinances of Mayfield Village, Ohio, <br />entitled "Solicitations at Private Residences"; and <br />WHEREAS, the aforesaid Chapter 739 provided, in part, in <br />Section 739.06 that canvassers and solicitors at private residences <br />are restricted in their activities in that canvassing and soliciting <br />is permissible only between the hours of 10:00 A.M, and 5:00 P.M. <br />Monday through Saturday; and <br />WHEREAS, recent decisions of the United States Supreme <br />Court, and other federal courts, pertaining to the issue of canvassers <br />and solicitors have indicated that '°reasonable hours" must be <br />established in regulating canvassers and solicitors; and <br />WHEREAS, said Federal Court decisions have further indicated <br />that the provisions for "reasonable hours" must take into account the <br />working schedules of families occupying residences within the munici- <br />pality enacting such ordinances, and must further recognize that many <br />families are two income families with husbands and wives both working <br />full-time schedules; and <br />WHEREAS, in taking into account the working schedules, the <br />aforesaid Federal Court decisions have strongly indicated that <br />canvassers and solicitors should be permitted to conduct their activi- <br />ties into the evening hours, stating that proper police registration <br />and regulation will provide the necessary safeguards for the health, <br />safety and welfare of the residents that might otherwise be endangered <br />by unregulated canvassers and solicitors; now, therefore, <br />BE IT ORDAINED BY THE COUNCIL OF HAYFIELD VILLAGE, OHIO, THAT: <br />Section 1. Section 739.06(b) of the Codified Ordinances <br />of Mayfield Village, Ohio, is hereby amended to read as follows: <br />(Deleted material appears like ~h~~ and new material appears <br />like THIS) <br />
