M.V. ORDINANCE N0. 84- 39 <br />Page -2- <br />amounts reported in said adjusted assessment, as aforesaid, which <br />assessments, more fully enumerated in Exhibit "A" attached hereto and <br />incorporated herein as if fully rewritten, are in proportion to the <br />special benefits conferred by said improvement and are not in excess <br />of any statutory limitations. <br />Section 3. This Council hereby finds and determines that <br />the adjusted assessments as now on file in the office of -said Clerk <br />are in the same proportion to the estimated assessments as the actual <br />cost of said improvement bears to the estimated cost of said improve- <br />ment upon which such estimated assessments were based. <br />Section 4. The assessment against each lot or parcel of <br />land shall be payable in cash within thirty (30) days after the <br />passage of this ordinance or, at the option of the owner, in twenty <br />(20) semi-annual installments with interest at the same rate as shall <br />be borne by the bonds to be issued in anticipation of the collection <br />of the same. All assessments and installments thereof remaining unpaid <br />at the expiration of thirty (30) days shall be certified by the Clerk <br />of this Council to the Cuyahoga County Auditor as provided by law to <br />be placed by him on the tax duplicate and collected as other taxes are <br />collected. <br />Section 5. The owner of any lot or parcel of land to be <br />assessed for the improvement herein may, within fifteen (15) days of <br />enactment of this ordinance, petition to the Council for deferment of <br />payment of assessments due on the basis of financial hardship pursuant <br />to the criteria set forth in Section 727.251 of the Ohio Revised Code. <br />In the event that Council determines that such petition for deferment <br />of payment is well taken, then Council may amend Resolution No. 83-7 <br />and this ordinance in order to reflect such deferment of payment for <br />said property owner. <br />Section 6. The Clerk of this Council is hereby authorized <br />and directed to cause notice of the passage of this ordinance to be <br />published once in a newspaper of general circulation in the municipal- <br />ity as required by law and to keep on file in her office the adjusted <br />assessments for said improvement. In addition thereto, the Clerk of <br />this Council is further authorized and directed to cause notice of the <br />passage of this ordinance to be mailed by regular U.S. Mail, postage <br />prepaid, to the owners of all lots and parcels of land to be assessed. <br />Section 7. The Clerk of this Council is further <br />authorized and directed to forward a certified copy of this ordinance <br />to the office of the Cuyahoga County Auditor within twenty (20) days <br />after its passage. <br />
