ORDINANCE N0. 84-. 41 <br />Page -5- <br />(D) STATUS OF EXECUTED RETURNS AND ASSESSMENTS - ANY <br />RETURN EXECUTED BY OR ANY ASSESSMENT MADE BY THE <br />ADMINISTRATOR PURSUANT TO THIS MUNICIPALITY'S ORDI- <br />NANCES SHALL BE PRIMA FACIE GOOD AND SUFFICIENT FOR <br />ALL LEGAL PURPOSES. THE ADMINISTRATOR MAY EXECUTE <br />SUPPLEMENTAL TAX RETURNS AND MAY ISSUE SUPPLEMENTAL <br />ASSESSMENTS WHENEVER THE ADMINISTRATOR HAS KNOWLEDGE <br />DERIV ED FROM ANY SOURCE INCLUDING THE TAXPAYER'S <br />FINANCIAL DATA THAT ANY EXECUTED TAX RETURN OR <br />ASSESSMENT IS IMPERFECT OR INCOMPLETE IN ANY MATERIAL <br />RESPECT. <br />(E) LIMITATION <br />ADMINISTRATOR'S <br />ADMINISTRATOR'S <br />THE RUNNING OF <br />TIONS SET FORTH <br />ORDINANCES. <br />OF PROSECUTIONS - NEITHER THE TAX <br />EXECUTION OF A RETURN NOR THE TAX <br />ASSESSMENT OF A TAXPAYER SHALL START <br />THE PERIOD OF LIMITATIONS ON PROSECU- <br />ELSEWHERE IN THIS MUNICIPALITY'S <br />Section 9. All prior ordinances inconsistent with this <br />ordinance in whole or in part are repealed to the extent necessary to <br />avoid conflict with this ordinance. <br />' Section 10. The passage of this Ordinance and the <br />repealing of the aforesaid sections is not intended to, and shall not, <br />impair in any way or affect or release any obligation or liability to <br />pay, declare or withhold taxes or file returns by virtue of income tax <br />provisions enacted or in effect prior to the passage of this <br />Ordinance. <br />Section 11. That the Council finds and determines that all <br />formal actions of this Council relating to the adoption of this <br />Ordinance have been taken at open meetings of this Council; and that <br />deliberations of this Council and of its committees, resulting in such <br />formal action, took place in meetings open to the public, in compli- <br />ance with all statutory requirements including the requirements of <br />Section 121.22 of the Ohio Revised Code. <br />Section 12. This Ordinance is hereby declared to be an <br />emergency measure immediately necessary for the. preservation of ,,the <br />health, safety and welfare of the residents of Mayfield Village, Ohio, <br />for the reason that the enactments and amendments authorized herein <br />are necessary to effectively impose and collect the municipal income <br />tax of Mayfield Village, Ohio, and pursue violations thereof. It shall <br />therefore take effect immediately upon passage by the affirmative vote <br />of not less than four (4) members elected to Council and approval by <br />
